Council Tax Reduction Refused or Cancelled in South Gloucestershire

A letter from South Gloucestershire Council telling you your Council Tax Reduction has been refused or cancelled is alarming — especially when you were counting on that support to keep your bill manageable. Before you panic, read the decision notice carefully. The council must tell you why, and you have a statutory right to challenge it. Overpayment recovery notices — where the council says you received too much CTR and now owe the difference — follow a similar pattern. Understanding what went wrong is the first step toward fixing it.

Common Reasons for Refusal

South Gloucestershire Council refuses CTR applications for specific, documented reasons. The most frequent:

Capital at or above £6,000. The working-age scheme has a hard capital ceiling. If your combined household savings, investments, ISAs, and other capital reach £6,000 or more, you receive zero CTR regardless of how low your earned income is. Unlike the pension-age scheme (£16,000 limit with no cap for Pension Credit recipients), there is no "tariff income" calculation — it is a binary pass/fail gate. If your capital is close to the limit, provide accurate statements and ask the council how it applies its capital rules before relying on a change in your balance.

Earned income of £230.01 or more per week. The top band of South Gloucestershire's earned-income grid pays 0% reduction. If your net weekly earnings — from employment or self-employment — reach this threshold, you receive no CTR. Remember that only earned income counts. Universal Credit elements, PIP, DLA, Carer's Allowance, and Child Benefit are all excluded from the calculation.

Incomplete evidence within one calendar month. The council gives you one calendar month from the date your claim is initiated or it requests additional evidence to supply the required documents. Miss the deadline and they can cancel your claim as "defective." This is the most preventable reason for refusal — and the most frustrating, because it has nothing to do with whether you actually qualify.

Not liable for council tax. You or your partner must be legally liable for council tax on the home. If you believe you are liable but are not named on the account, ask the council's billing team to correct the account before your CTR claim is assessed. An unnamed occupant cannot claim simply because they pay rent or contribute to the bill.

What to Do When You Are Refused

You have one calendar month from the date on the decision notice to request a formal written review. This is not optional bureaucracy — it is a statutory right under Section 16 of the Local Government Finance Act 1992, and missing the deadline means losing the right to challenge.

Your written review request must include:

  1. Your full name, address, and 9-digit council tax reference (starts with 4)
  2. The date and reference number of the decision you are challenging
  3. The specific grounds — why you believe the decision is wrong (e.g., the council miscounted your capital, used the wrong income figure, or failed to apply a disregard)
  4. Supporting evidence for your grounds

Send it by email to [email protected] or post it to South Gloucestershire Council, Housing Benefit, PO Box 1953, Bristol, BS37 0DB. Keep a copy and note the date you sent it.

The council has two months to respond. If they uphold the original decision, you can escalate to the Valuation Tribunal for England within two months of their response. If they fail to respond within two months, you can go straight to the Tribunal within four months of your original written grievance.

When CTR Is Cancelled Mid-Award

A running CTR award can be stopped if:

  • You fail to respond to a periodic review questionnaire within 21 days
  • You report a change of circumstances that takes you outside eligibility (capital reaching £6,000, earned income reaching £230.01, moving out of the property)
  • The council discovers unreported changes through data matching or third-party information

Cancellation for failing to respond to a review is particularly harsh because the underlying entitlement may not have changed at all. If you missed a review letter — perhaps it went to an old address or got lost in the post — contact the council immediately, explain what happened, and provide the evidence the review was requesting. Ask whether the council can restore your award and from what date; do not assume a new application is unnecessary.

Overpayment Recovery (Excess Reduction)

If the council paid you more CTR than you were entitled to — because of a late change report, an error on your application, or an administrative mistake by the council itself — they create an "excess reduction." The council recovers it through your council tax billing account, which can increase your monthly instalments or trigger an immediate demand. If the revised bill is unmanageable, contact the council about payment arrangements. You can also:

  1. Request a formal review if you believe the overpayment was calculated incorrectly — perhaps the council backdated the cancellation further than warranted, or failed to account for a change you did report on time
  2. Ask to spread the repayment over a longer period by emailing [email protected] and requesting 12-month instalments instead of 10
  3. Apply for Section 13A hardship relief if the overpayment recovery pushes you into genuine financial hardship

If the excess reduction was caused by the council's own error rather than anything you did or failed to do, note this in your review request. While councils can still recover overpayments caused by official error, the circumstances may support a discretionary write-off under Section 13A.

When Overpayments Lead to Arrears

An unexpected excess reduction on top of the mandatory 23% minimum payment can quickly spiral into council tax arrears. If you receive a court summons or liability order, that is a debt issue and falls outside what CTR can address. Contact free debt advice immediately:

  • StepChange: 0800 138 1111
  • National Debtline: 0808 808 4000
  • Citizens Advice South Gloucestershire: 0808 278 7947

Do not ignore arrears correspondence — early engagement with the council's collections team gives you far more options than waiting for enforcement action.

Preventing Refusal and Cancellation

Most refusals and cancellations are preventable:

  • Gather all documents before you apply — payslips, bank statements, benefit letters — so the one-calendar-month evidence period never catches you out
  • Report every change within 21 days through the Change of Circumstances portal
  • Respond to review letters immediately — mark them as urgent when they arrive and keep copies of everything you send back
