How to Appeal a Council Tax Reduction Decision in South Gloucestershire

When You Can Appeal

If South Gloucestershire Council makes a decision about your Council Tax Reduction that you disagree with — the award amount, which income band they've placed you in, a backdating refusal, or a decision to cancel your claim — you have a statutory right to challenge it.

The appeal process has two formal stages. Skipping straight to stage two without attempting stage one can get your appeal rejected.

Stage 1: Written Reconsideration Request

You must submit a formal written grievance to South Gloucestershire Council within one calendar month of the date on your decision notice.

A phone call to the council doesn't count. Neither does an informal email asking why your reduction is less than expected. The request must be in writing, and it must include:

  1. Your full name and address
  2. Your 9-digit council tax account reference
  3. The date and reference of the decision you're challenging
  4. The specific grounds — exactly what you think they got wrong (incorrect earnings calculation, wrong band, failure to apply a disregard, erroneous capital assessment)
  5. Supporting evidence

Send it to [email protected] or post it to South Gloucestershire Council, Housing Benefit, PO Box 1953, Bristol, BS37 0DB.

Keep a copy and note the date you sent it. The deadline matters.

Stage 2: Valuation Tribunal for England

The council has two calendar months to consider your reconsideration request and issue a written response.

You can appeal to the Valuation Tribunal for England (VTE) in two situations:

  1. The council responds but upholds its decision — you have two months from the date of their response letter to lodge a VTE appeal
  2. The council doesn't respond at all within two months — you can appeal directly to the VTE, but you must do so within four months of first contacting the council

The VTE is an independent statutory tribunal, not part of the council. Appeals are submitted online through valuationtribunal.gov.uk. The tribunal has the power to overturn the council's decision if it finds the scheme rules or relevant regulations were misapplied.

What You're Appealing Matters

There's an important distinction between different types of council tax dispute:

CTR award decisions (band placement, backdating, eligibility) → internal review → Valuation Tribunal for England

Property valuation band (your home is in the wrong band) → challenge via the Valuation Office Agency at gov.uk/voa, not the council

Council tax liability or discount disputes (Single Person Discount, exemptions, who's liable) → South Gloucestershire Revenues Team at [email protected]

Administrative failures (unreasonable delays, lost paperwork, procedural errors) → complete the council's complaints procedure first, then escalate to the Local Government and Social Care Ombudsman at lgsco.org.uk

Filing the wrong type of challenge with the wrong body wastes time and doesn't preserve your deadlines.

Keep Paying While You Appeal

Submitting an appeal does not suspend your obligation to pay council tax. You must continue paying the billed amount until a formal decision is issued. If you win and the award is backdated, the council will issue a revised bill and credit the overpayment.
