How to Appeal a Somerset Council Tax Reduction Decision
Somerset Council refused your Council Tax Reduction claim, gave you a lower discount than you expected, or rejected your backdating request. You don't have to accept it. There's a formal two-tier appeal process, and it costs nothing — but the deadlines are strict and missing them locks you out.
Tier 1: Written Grievance to Somerset Council
Your first step is a formal written grievance served directly on Somerset Council's Revenues & Benefits team under Section 16 of the Local Government Finance Act 1992. This isn't a casual complaint — it's a legal notice that triggers a formal review obligation.
Your grievance must include:
- The decision you're disputing — reference the CTR notification letter date and your council tax account number
- The specific calculation or ruling you believe is wrong — income band placement, disregard not applied, non-dependant deduction incorrect, backdating refused
- Your legal or factual grounds — why you believe the decision is wrong, with supporting evidence
Send it in writing — by letter or through the council's online portal. Keep a copy and note the date you sent it. The council then has two calendar months to investigate and issue a formal written response.
During this time, you must keep paying your council tax bill as billed. Filing a grievance does not suspend your liability. If you stop paying, the council can start enforcement proceedings regardless of the ongoing review.
Tier 2: Valuation Tribunal for England
If the council upholds its decision, or if two months pass without any response, you can escalate to the Valuation Tribunal for England (VTE) — an independent tribunal that hears council tax disputes.
The deadlines depend on what happened at Tier 1:
- If the council responded within two months: you have two months from the date of their response to file your VTE appeal
- If the council didn't respond at all: you have four months from the date you submitted your grievance to file directly with the VTE
Appeals are submitted online at valuationtribunal.gov.uk or by phone on 0300 123 2033. There's no fee.
The VTE is a formal tribunal, but most appellants represent themselves. You'll present your case, explain why the council's decision was wrong, and provide your evidence. The council sends a representative to present their side. The tribunal panel makes a binding decision.
Common Grounds for Appeal
Common issues people may dispute include:
- Incorrect income assessment — the council counted income that should have been disregarded (PIP, DLA, UC Housing Element, Child Benefit, Carer's Allowance)
- Wrong household category — being assessed as a couple when you're a single person, or having the wrong number of children in the band calculation
- Non-dependant deduction errors — a £10/week deduction applied to someone the council has incorrectly treated as a non-dependant living in your household
- Backdating refusal — good cause existed but the council didn't accept it
- Failure to apply disability or earnings disregards — the £30/week disability disregard or £25/week earnings disregard not subtracted from assessable income

Don't Confuse CTR Appeals with Band Challenges
This is a separate process from challenging your council tax band. Property band disputes go to the Valuation Office Agency (VOA), not to Somerset Council and not to the VTE for CTR purposes. If you think your property is in the wrong band, that's a VOA challenge. If you think the council calculated your discount wrong within the correct band, that's a CTR appeal.
