How to Appeal a Cornwall Council Tax Reduction Decision
When You Can Appeal
If you think Cornwall Council got your Council Tax Support calculation wrong — miscounted your income, applied the wrong non-dependant deduction, used the wrong Applicable Amount, set the wrong start date — you have the right to challenge it. The process is free at every stage.
You can also appeal if the council refuses your application entirely and you believe you meet the eligibility criteria. What you cannot appeal through this route is the 75% cap itself or a discretionary Exceptional Relief decision — those are policy choices, not individual calculation errors.
Stage 1: Written Grievance to Cornwall Council
You must start with an internal review. Phone calls don't count — the grievance has to be in writing. Send it to Cornwall Council Revenues and Benefits, stating clearly what you think is wrong: the income figure they used, the deduction they applied, the date they chose, whatever the error is.
Put it in writing the moment you spot the problem. The council then has two months to review and respond. They'll either correct the calculation and issue a new Decision Notice, or uphold their original decision with a written explanation.
Stage 2: Valuation Tribunal for England
If Cornwall Council rejects your grievance in writing, or doesn't respond within two months, you can escalate to the Valuation Tribunal for England (VTE). This is a fully independent tribunal — nothing to do with Cornwall Council.
Time limits: You must lodge the VTE appeal within two months of the council's written grievance response. If the council simply didn't respond, you have four months from when you submitted your original grievance.
Cost: Entirely free. No court fees, no legal costs if you lose, no risk of paying the council's costs.
How to submit: Online through valuationtribunal.gov.uk, or using paper appeal forms. The VTE website walks you through the process.
What the VTE can do: The tribunal can overturn Cornwall Council's decision and recalculate your entitlement if the council misapplied its own scheme rules. It can order the council to issue a corrected award with backdated adjustment.
What the VTE cannot do: It cannot change the local scheme itself (like removing the 75% cap), and it has no power over discretionary hardship decisions under Section 13A(1)(c).

Practical Tips
Keep every piece of paper the council sends you — the original Decision Notice, the grievance response, revised demand notices. If you're challenging an income calculation, pull together your own evidence (payslips, UC award statements, bank statements) showing the correct figures.
Citizens Advice Cornwall (0808 812 7156) offers free tribunal representation. If your case involves disability benefits or carer-related income that was wrongly included, Disability Cornwall (01736 759500) can also help.
The Cornwall Council Tax Reduction guide covers both the internal review and VTE appeal process with timelines, template language, and a checklist of what to include.
