How to Appeal a Council Tax Reduction Decision in North Yorkshire
The Two-Stage Appeal Process
If North Yorkshire Council has refused your Council Tax Reduction claim, placed you in a lower discount band than you expected, or denied a backdating request, you have the right to challenge the decision. The process has two mandatory stages — you can't skip the first one.
Stage 1: Written grievance to the council. You must submit a formal written challenge directly to North Yorkshire Council's Revenues and Benefits team. Your grievance needs to state the specific grounds: which part of the decision you disagree with and why. The council then has two months to review and respond in writing.
Stage 2: Appeal to the Valuation Tribunal for England (VTE). If the council rejects your grievance or fails to respond within two months, you can appeal to the VTE. The deadline is four months from the date you originally sent your written grievance to the council.
VTE appeals are free. There are no tribunal fees. You're only responsible for your own costs if you choose to hire a solicitor — but most CTR appeals don't require one.
What to Include in Your Written Grievance
A vague "I think this is wrong" won't get far. Your grievance should address the specific calculation or rule the council applied:
- Income band placement: did the council include income that should have been disregarded? The housing element of Universal Credit, PIP, DLA, Child Benefit, and Carer's Allowance are all fully excluded from the income assessment. If any of these appeared in your assessed income, that's a clear error.
- Disregard errors: the £25/week single person disregard, £50/week couple/lone parent disregard, or £40/week disability disregard may not have been applied. Check your decision letter against the scheme rules.
- Capital miscalculation: was an exempt asset counted? Did the council assess capital you no longer hold?
- Backdating refusal: if you requested backdating and were refused, your grievance should explain in more detail why you had good cause for the delay.
Attach any supporting documents: payslips showing the correct income, benefit award letters, bank statements proving capital was under £6,000 at the relevant date.
The Valuation Tribunal Process
If you reach Stage 2, the VTE conducts an independent review. The tribunal has the authority to determine both eligibility and the amount of your award under the adopted scheme rules. You can submit your appeal online through the Valuation Tribunal for England portal.
The tribunal typically decides based on written submissions, though you can request an oral hearing. The VTE's decision is binding on the council.

Keep Paying While You Appeal
Lodging a grievance or appeal does not pause your Council Tax liability. You must continue paying according to your demand notice while the dispute is resolved. If the appeal succeeds, any overpayment is credited back to your account.
If paying the full amount while appealing would cause genuine hardship, consider applying for the Exceptional Hardship Fund alongside your appeal.
