How to Appeal a Council Tax Reduction Decision in County Durham
When You Can Challenge a CTR Decision
You have the right to dispute any decision Durham County Council makes about your Council Tax Reduction. Common reasons to challenge include:
- The council placed you in the wrong income band
- A disregard wasn't applied (DWP benefits counted when they shouldn't have been, or the £25 earnings disregard was missed)
- A non-dependant deduction was applied when it should have been waived
- A backdating request was refused
- Your CTR was reduced or stopped after a change of circumstances you disagree with
The dispute process has two stages: a council-level reconsideration, then an independent tribunal if needed.
Stage 1: Written Reconsideration With the Council
Start by submitting a formal written challenge directly to Durham County Council. Don't just phone — the council needs your dispute in writing to start the statutory clock.
Your letter or email should include:
- Your name, address, and Council Tax account reference
- The specific decision you're disputing and the date of the decision notice
- The legal or factual error you believe the council made
- Any supporting evidence (payslips showing the correct earnings figure, benefit award letters, bank statements proving capital is below the threshold)
Be specific. "I think my discount should be higher" is weak. "The decision notice shows my assessed income as £180 per week, but my net earnings are £150 per week and the £25 disregard has not been applied, which should place me in Band 2 (75%) rather than Band 3 (50%)" gives the council something concrete to check.
The council has two calendar months to respond. They may recalculate your award and issue a revised decision, ask for further evidence, or uphold the original decision with a written explanation.
Stage 2: Valuation Tribunal for England (VTE)
If the council rejects your challenge — or fails to respond within two months — you can appeal to the Valuation Tribunal for England. The VTE is an independent judicial body, completely separate from the council.
Deadlines:
- If the council responded: appeal within two months of the date of their written response
- If the council didn't respond within two months: appeal within four months of the date you submitted your original written challenge
Appeals are submitted through the VTE's online portal. The process is free — there's no fee to lodge an appeal or attend a hearing.
VTE appeals typically take around nine months from submission to hearing. You can present your case yourself — you don't need a solicitor. Citizens Advice County Durham and the DCC Welfare Rights Service both help with tribunal preparation at no cost.

What the Council Can and Can't Decide
One common source of confusion: the council handles CTR decisions, but a different body handles property band disputes.
- Council Tax Reduction disputes (income bands, disregards, deductions, backdating) → Durham County Council reconsideration → Valuation Tribunal for England
- Property band challenges (you think your home is in the wrong council tax band) → Valuation Office Agency (VOA), not the council
Challenging your property band is a completely separate process that goes through the VOA and is free. A successful band challenge can lower your gross bill, which then reduces the amount you pay even after CTR.
Keep Paying While You Appeal
Challenging a CTR decision does not pause your Council Tax bill. You must keep paying whatever the council currently says you owe. If your appeal succeeds, the council credits the reduction to your Council Tax account and issues a revised demand notice with the recalculated balance and instalments.
If paying the disputed amount would cause genuine hardship while the appeal is pending, consider applying for Section 13A discretionary hardship relief as a temporary measure.
The County Durham Council Tax Reduction guide includes a dispute-tracking template to help you record submission dates, deadlines, and council reference numbers through both stages.
