Sunderland Council Tax Arrears and Debt Help
What Happens When You Fall Behind on Council Tax in Sunderland
Missing council tax payments in Sunderland triggers a fixed escalation sequence. Knowing where you are in that sequence — and what the council can and can't do at each stage — helps you act before things get worse.
This post explains the timeline and points you to free, professional debt advice. We are not debt advisers — if you're already facing enforcement, speak to one of the organisations listed below before doing anything else.
The Enforcement Timeline
Stage 1 — Reminder notice. If you miss a payment, Sunderland sends a reminder giving you seven days to pay. If you do not pay, you lose the option to pay by instalments and may receive a court summons.
Stage 2 — Second reminder or summons. If you miss a second payment after the first reminder, Sunderland sends a second reminder giving you seven days to pay. If you do not pay, you lose the right to pay by instalments and receive a summons. If you miss a later instalment after two reminders, the council sends no further reminder and issues a summons.
Stage 3 — Court summons. Sunderland City Council applies to the magistrates' court for a liability order. Summons costs are added to your balance; check the summons for the amount. You can attend the hearing and give your reasons for disputing the bill or the council's application.
Stage 4 — Liability order granted. This gives the council several collection powers:
- Attachment of earnings — your employer deducts a fixed amount from your wages
- Attachment of benefits — deductions from Universal Credit, ESA, JSA, Pension Credit, or other eligible benefits
- Enforcement agents (bailiffs) — the council can instruct certificated agents to visit your home and take control of goods
- Charging order — if you own your home and the debt is over £1,000, the council can ask a court to secure the debt against the property; it may be payable when you sell
- Bankruptcy petition — for debts over £5,000
The council decides which route to take. They don't always jump straight to bailiffs — but they can.
Payment Plans and What to Ask For
Before a liability order is granted, Sunderland City Council can agree to a revised instalment plan. Phone their customer services on 0191 520 5551 as early as possible — ideally when you receive the first reminder.
Explain your situation clearly and offer a realistic amount you can afford. The council has no legal obligation to accept a plan at this stage, but most do when you engage early.
After a summons, the council may agree to a payment plan. It will still apply for a liability order and add costs, but says recovery action will be paused while you maintain the arrangement.

Claim Council Tax Reduction to Stop the Gap Growing
If your arrears built up because your income dropped and you never claimed Council Tax Reduction, apply now. Sunderland's scheme can award up to 100% support for the lowest-income households, and you can request one month of backdating (working-age) if you can show good cause for not applying earlier.
A Council Tax Reduction award may reduce the bill for periods when you qualify, but it does not automatically clear earlier arrears or any remaining bill.
Our Sunderland Council Tax Reduction guide covers the full claim process — eligibility, evidence, backdating, and the hardship fund — so you can get your award started while tackling the arrears separately.

The Hardship Fund as a Last Resort
Sunderland's Section 13A(1)(c) discretionary hardship fund exists for residents facing exceptional financial difficulty. It can reduce your Council Tax bill, but it's awarded case by case and isn't guaranteed. If a debt adviser thinks it's appropriate, they can help you with the application.
