Birmingham Council Tax Arrears and Debt: Summons, Liability Orders and Where to Get Free Help

The Enforcement Stages

Council tax debt in Birmingham follows a fixed legal sequence. Each stage adds costs and narrows your options, which is why acting early makes such a difference.

Reminder notice. If you miss an instalment, Birmingham City Council sends a reminder asking you to bring the account up to date within seven days. If you miss another payment later, the council may send a second reminder. If you miss payments for a third time in the year, a final notice requires the full remaining balance within 14 days. If you do not pay within the deadline on a reminder, you may lose the right to pay in instalments and the council may apply for a summons.

Summons. If you still haven't paid (or arranged to pay), the council applies to the Magistrates' Court for a summons. A summons adds court costs of £75 to your account. You'll receive a summons letter telling you the date of the hearing.

Liability order. At the court hearing, if the council proves you owe the money and haven't paid, the magistrates grant a liability order. This is a legal document that gives the council additional powers to recover the debt. You don't have to attend the hearing. The magistrates cannot decide whether your bill should have included a discount, exemption or Council Tax Support award; contact the council and use the relevant review route if you dispute the amount.

Enforcement action. With a liability order in hand, the council can use several methods to collect:

  • Pass the debt to enforcement agents (bailiffs), who can visit your home and charge their own fees on top
  • Make deductions directly from your earnings through your employer
  • Make deductions from your Universal Credit or other benefits
  • Apply for a charging order against your property
  • As a last resort, apply to make you bankrupt or commit you to prison (rare, and courts scrutinise these applications heavily)

What a Liability Order Means in Practice

A liability order doesn't appear on your credit file — council tax debt isn't reported to credit reference agencies in the same way that bank debts are. But it does give the council wide-ranging powers. For 2026, Birmingham's enforcement fees are £79 at the compliance stage, £247 for an enforcement visit, and an additional 7.5% of the amount to be recovered if it exceeds £1,900. A sale-of-goods stage adds £116, plus 7.5% if the amount to be recovered exceeds £1,900. Enforcement visit fees do not apply if you receive Council Tax Support.

The total cost escalation from a missed £150 instalment to a full enforcement action can easily double or triple the original amount owed.

Your Options at Each Stage

Before the summons: Contact Birmingham City Council and ask to set up a payment arrangement. The council's collection team can reschedule instalments or agree a reduced payment plan. You don't need to wait until you've been contacted — calling proactively often gets better terms.

After the summons but before the hearing: You can still contact the council to agree a payment arrangement. If you pay the full amount including court costs before the hearing, the summons is usually withdrawn.

After the liability order: The council must still decide which enforcement method to use. If you contact them (or a debt adviser contacts them on your behalf) and propose a reasonable repayment plan, many councils — including Birmingham — will agree to instalments rather than sending bailiffs. A debt adviser can negotiate on your behalf at no cost.

Free Debt Advice — Use It

This is where independent, professional help matters. Council tax debt has specific legal protections and processes that general advice doesn't cover. These services are free, confidential, and staffed by trained debt advisers:

StepChange Debt Charity — 0800 138 1111 or stepchange.org. They can set up a formal debt management plan covering all your debts including council tax.

National Debtline — 0800 808 4000 or nationaldebtline.org. Telephone and online advice, including sample letters for negotiating with the council.

Citizens Advice — 0808 278 7990 (Birmingham line) or citizensadvice.org.uk. They can check whether you're entitled to Council Tax Support that would reduce your ongoing bill as well as help with the arrears.

Connected Communities hubs in Birmingham libraries can book you a face-to-face appointment with a welfare adviser.

Arrears and Council Tax Support

Being in arrears doesn't stop you from claiming Council Tax Support. If you qualify, the CTS award reduces your current bill — though it doesn't wipe out debt already owed. It can stop the problem from growing while you deal with the backlog.

If you've been paying council tax without claiming CTS you were entitled to, backdating is possible — up to three months for pension-age claims (automatic) and one month for working-age claims (with good cause). A successful backdate creates a credit on your account that the council can offset against arrears.

The Birmingham Council Tax Reduction guide covers the claiming process and backdating rules. It does not provide debt advice — if you have a summons, liability order, or enforcement agents involved, contact one of the free services above as your first step.
