Care Leaver Council Tax Debt and Arrears Help

How Care Leavers End Up with Council Tax Debt

The pattern is depressingly common. A care leaver moves into their first tenancy. The council tax bill arrives. They're eligible for a Section 13A(1)(c) care leaver discount — but nobody told them about it, or the application gets stuck in processing, or the PA verification letter was never sent.

Meanwhile, council tax recovery can continue. If you miss an instalment, the council will send a reminder giving you 7 days to pay. If you do not pay within 7 days, the whole year's bill becomes due. You will be sent a second reminder if you miss another payment, and can get no more than two reminders in a financial year. If you miss a payment for a third time, the council will send a final notice requiring the whole year's bill; if you do not pay within 7 days, the council may take legal action, including seeking a liability order. By the time anyone notices, the care leaver may have a liability order and enforcement agents at the door — all for a debt they shouldn't have owed in the first place.

If this is happening to you right now, the most important thing is to act today rather than ignore the letters. Council tax enforcement escalates fast, and ignoring it makes every step harder to reverse.

If You're Eligible for the Discount — Apply Now

If you haven't applied for the care leaver Section 13A discount yet, do it immediately. Contact the revenues team and explain that you're a care leaver who qualifies for the discount and that you're applying retrospectively. Ask for an immediate hold on all enforcement action while your application is processed.

If your application is successful and the council backdates the discount, the council recalculates the account for the period covered by the award. Ask it to confirm in writing what happens to any arrears, summons, liability order, or enforcement action; a revised account does not automatically notify the court or enforcement agent.

If a court summons has already been issued, tell the revenues team in your application. Liability-order costs may also be on the account; ask the council to state the amount and whether those costs remain after it recalculates your bill.

If You're Already Past the Age Limit

If you've turned 25 (or 21, depending on your council's policy) and the arrears relate to a period when you were within the age range, you can still apply for backdated relief. The key question is whether you met the eligibility criteria during the period the arrears cover, not whether you meet them now.

If the arrears are for a period after your 25th birthday, a policy that ends at 25 will not cover that period. Your options are Council Tax Reduction (if your income is low enough), a general Section 13A(1)(c) hardship application, or a payment arrangement with the council.

Free Debt Advice — Use It

If council tax debt is causing you financial distress, contact one of these organisations for free, confidential, and regulated debt advice:

  • StepChange — free debt management plans and Breathing Space applications (0800 138 1111)
  • National Debtline — free specialist council tax debt advice (0808 808 4000)
  • Citizens Advice — local advisers who can negotiate with the council on your behalf

These services can assess whether you qualify for Breathing Space. A standard Breathing Space lasts up to 60 days and pauses enforcement on included debts; a debt adviser must apply on your behalf, and current council tax instalments remain payable.

Your Personal Adviser can also intervene. Core duties under Section 23C of the Children Act 1989 generally last until age 21, with specified education or training duties continuing in some cases. From age 21 until you reach 25, a former relevant child can request further advice and support under Section 23CZB. Ask your PA what support is available and whether they can contact the billing council with you.

If Enforcement Agents Are Involved

If enforcement agents contact you, or you have received a summons or liability order, contact a free debt advice service immediately. Enforcement rights and payment arrangements depend on the stage of the case and your circumstances, so get advice before agreeing to a plan.

If you believe the care leaver discount should have been applied, contact the revenues team and ask for an account review and written confirmation of any recovery hold. A pending application does not automatically pause enforcement.

The Care Leaver Council Tax Claim System covers the full enforcement timeline and the steps to reverse wrongful action, including the claim audit log to track every communication with the council.
