Cornwall Council Tax Arrears — What Happens and Where to Get Free Debt Advice
A single missed council tax payment in Cornwall can escalate fast. Cornwall Council issues a reminder notice, and if you don't pay within seven days, you lose the right to pay by instalments — the full remaining annual balance becomes due immediately. Understanding the enforcement timeline and knowing where to get free help makes the difference between regaining control and facing a bailiff at the door.
The Cornwall Council Tax Enforcement Timeline
The process follows a standard sequence set out in the Council Tax (Administration and Enforcement) Regulations 1992:
Reminder notice — Sent after a missed instalment. You have seven days to pay the missed amount and keep your instalment plan.
Second reminder — If you miss another payment after settling the first reminder, Cornwall Council can send a second reminder. A maximum of two reminder notices can be sent in a financial year.
Final notice — If you miss a further payment in the same financial year, Cornwall Council can issue a final notice making the full annual balance due.
Summons and Magistrates' Court — Cornwall Council applies to the Magistrates' Court for a liability order. You'll receive a court summons with a hearing date. Cornwall adds a £73 summons cost to your debt, then a further £25 if the court grants a liability order.
Liability order granted — Once the court grants the order, Cornwall Council gains wider enforcement powers. At this stage the council can:
- Deduct directly from your wages (an attachment of earnings order)
- Deduct from your Universal Credit or other benefits
- Instruct enforcement agents (bailiffs) to visit your property
- Apply a charging order against your home
- In extreme cases, pursue bankruptcy proceedings or committal to prison
Enforcement agents (bailiffs) — If Cornwall Council instructs enforcement agents, they add their own fees on top. The compliance stage adds £79. If they visit your property, that adds £247 plus 7.5% of any balance over £1,900.
Your Rights During Enforcement
You can ask Cornwall Council to spread your bill over 12 monthly instalments instead of the usual 10. If you request this after March, the payments will run only for the months left until the next March.
If a liability order has been granted but you can demonstrate financial hardship, you can still negotiate a payment arrangement directly with the council's revenues team before bailiffs get involved.
Enforcement agents cannot force entry into your home on their first visit for council tax debt. If they have already gained peaceful entry and you later breach a controlled goods agreement, they may be able to return and use reasonable force to enter.
