County Durham Council Tax Arrears Help

Council Tax Arrears Are a Priority Debt

If you have fallen behind on council tax in County Durham, this is classified as a priority debt under UK debt advice guidelines. That means it ranks above credit cards, personal loans, and catalogue debts in terms of what needs paying first. The consequences of unpaid council tax escalate faster and more severely than most other household debts — councils have enforcement powers that other creditors do not.

This post is not debt advice. It explains what happens, what your options are, and exactly where to get free expert help. Anyone with council tax arrears should contact a free debt advice service and Durham County Council's recovery team promptly.

Council Tax Recovery in County Durham

Council tax arrears can lead to court recovery or enforcement action. Contact Durham County Council's recovery team promptly to confirm the status of your account. If you are facing active enforcement, seek immediate free debt advice from Citizens Advice County Durham, StepChange, or National Debtline.

What to Do Right Now

Step 1: Get free debt advice and contact the council's recovery team promptly. A debt adviser can help you understand the options available for your circumstances.

  • StepChange Debt Charity: 0800 138 1111 (free; Monday–Friday 8am–8pm, Saturday 9am–2pm)
  • National Debtline: 0808 808 4000 (free)
  • Citizens Advice County Durham: 0808 278 7821 (free)

Step 2: Check whether you should be receiving Council Tax Reduction. Many people with arrears are entitled to CTR but have never claimed, or their claim lapsed when they moved to Universal Credit. If you qualify for a discount, the council will recalculate your bill — and a backdated reduction may reduce the amount owed.

You can apply for CTR at durham.gov.uk/counciltaxreduction. A CTR application does not automatically put an arrears or enforcement case on hold; contact the council's recovery team and a debt adviser about your current case. A successful claim can reduce the amount owed.

Step 3: Apply for hardship relief if you cannot pay even the minimum. Durham County Council operates a discretionary hardship fund under Section 13A of the Local Government Finance Act 1992. If your income is so low that even the 10% minimum CTR payment causes genuine hardship, you can apply for additional relief. This requires a detailed income and expenditure schedule plus six months of bank statements.

What This Guide Does Not Cover

This post covers the process and the signposting. It is not debt advice and cannot tell you what to pay first, how to negotiate a specific payment plan, or whether a Debt Relief Order or bankruptcy is appropriate for your situation. Those decisions need professional assessment of your full financial picture — which is exactly what StepChange, National Debtline, and Citizens Advice provide, free of charge.

If you are not yet in arrears but worried about affording your bill, the County Durham Council Tax Reduction guide explains how to check whether you qualify for a discount, how to apply, and how to access the hardship fund before things reach the enforcement stage.
