Bolton Council Tax Arrears: What Happens and Where to Get Help
The Enforcement Ladder in Bolton
When you miss a council tax payment in Bolton, the council follows a set legal sequence. Understanding where you are on this ladder matters because your options narrow at each stage.
Reminder notice — sent after the first missed payment. You have seven days to bring the overdue instalment up to date. If you do, your instalment plan continues as normal; if you do not, the instalments can be cancelled and the remaining annual balance becomes due in full.
Second reminder and instalment cancellation — if you caught up after an earlier reminder but fall behind again, Bolton Council issues a second reminder. If you do not catch up, the remaining annual balance becomes due in full. A third missed payment can lead to a summons without further warning. Final notices are used for overdue arrears from previous years and for balances left after someone moves out.
Summons — if the balance remains unpaid after instalments are cancelled or a final notice is sent, the council issues a summons to the magistrates' court. You'll receive a summons with a court date. Bolton adds £98 in summons costs to your debt.
Liability order — if the debt has not been paid by the hearing, the court can grant a liability order. Bolton Council can then use further recovery methods, including an attachment of earnings, deductions from eligible benefits, or enforcement agents (bailiffs). A charging order may be considered for arrears over £1,500 after other recovery methods have failed or are unsuitable. Committal proceedings may follow if enforcement agents cannot recover the balance and a court finds wilful refusal or culpable neglect.
What to Do at Each Stage
The single most important step at any stage is to contact Bolton Council on 01204 331599 before the next escalation. Councils are more willing to arrange payment plans with people who engage early than with people who ignore correspondence.
If you're at the reminder or final notice stage, you can often negotiate a revised payment schedule. If a liability order has already been granted, you still have the right to propose a payment arrangement — but the council isn't obliged to accept one, and enforcement agent fees start accumulating once a case is passed to bailiffs.
At every stage, check whether you qualify for Council Tax Reduction. A successful CTR claim can reduce your ongoing liability from the Monday after the council receives it and create a credit on your account that offsets arrears.
