How to Appeal a Council Tax Reduction Decision in Sefton

A refusal letter from Sefton Council isn't the end of the road. The law gives you a clear appeals process — and the final stage, the Valuation Tribunal for England, is completely free. Most people never get that far, because the internal review often resolves the issue.

Step 1: Understand the Decision

Your Council Tax Reduction determination notice should explain what was decided, what income and capital figures were used, and how the award (or refusal) was calculated. Read it carefully. Common triggers for disputes include:

  • Income assessed too high (wrong payslip period, overtime treated as regular earnings)
  • Capital assessed above £6,000 when it shouldn't be
  • Non-dependant deductions applied incorrectly (wrong income tier, or someone who should be exempt)
  • Backdating refused without proper consideration of your good-cause evidence
  • Hardship fund application denied

If the figure looks wrong, check it against your own records before appealing. Sometimes a simple phone call to 0345 140 0845 clears up a data entry error.

Step 2: Submit a Section 16 Written Grievance

If you disagree with the decision, you must submit a formal written grievance under Section 16 of the Local Government Finance Act 1992. This isn't optional — you can't skip straight to the tribunal.

Send your grievance promptly to Sefton Council; the published scheme gives the council two months to respond. Write to:

By post: Sefton Council Revenues & Benefits Service, PO Box 21, Bootle, L20 3US

By email: [email protected]

In your letter, state:

  • Your name, address, and Council Tax reference number
  • Which decision you're challenging and the date of the notice
  • Why you believe the decision is wrong — be specific about figures, dates, or evidence that was overlooked
  • What outcome you're requesting (recalculation, backdating, revised non-dependant deduction, etc.)

Attach any supporting evidence the council didn't have or didn't properly consider.

Step 3: Wait for the Internal Review

Sefton has two calendar months to conduct an internal review and respond in writing. During this time, your original Council Tax bill remains in force. If the council changes its mind, you'll receive a revised determination notice and an adjusted bill.

If the council upholds the original decision, the response letter will explain its reasoning.

Step 4: Escalate to the Valuation Tribunal for England

If Sefton rejects your grievance — or fails to respond within two months — you have the right to appeal to the Valuation Tribunal for England (VTE).

The VTE is an independent judicial body. It can recalculate your Council Tax Reduction, overturn backdating refusals, and order Sefton to adjust your bill. The process is entirely free.

Deadline: File your VTE appeal within two months of the date on Sefton's decision notice. If the council has not responded within two months, file within four months of the date you first contacted the council.

How to file: Submit your appeal online at valuationtribunal.gov.uk. You'll need your decision notice, your grievance letter, the council's response (if any), and your supporting evidence.

If the VTE accepts your appeal, you should expect to attend a hearing. The Tribunal currently holds hearings remotely.

Common Appeal Grounds

  • Incorrect income calculation: The council used the wrong pay period, included disregarded income (PIP, DLA, Child Benefit), or failed to apply your earnings disregard
  • Capital miscalculation: Funds that should be disregarded (personal injury trust, property being sold) were counted
  • Non-dependant error: A deduction was applied for someone who's exempt (under 18, full-time student, receiving Income Support)
  • Backdating refusal without proper consideration: You provided good-cause evidence but the council didn't engage with it
  • Procedural error: The council didn't follow its own scheme rules or failed to apply statutory uprating

A Note on Timelines

If Sefton has not responded within two months, you can appeal to the VTE and must do so within four months of your first contact with the council. Keep paying your Council Tax bill as assessed; an appeal does not itself pause collection action.

Our Sefton Council Tax Reduction guide walks you through the full appeals process, including how to structure your Section 16 grievance letter and what evidence the Valuation Tribunal weighs most heavily.
