How to Appeal a Council Tax Reduction Decision in Liverpool

If Liverpool City Council has refused your Council Tax Reduction claim, calculated it wrong, or denied a backdating request, you have a legal right to challenge the decision. The process has two stages — an internal reconsideration with the council first, then a free appeal to an independent tribunal if the council doesn't change its mind.

Stage 1: Request a Reconsideration

Before you can appeal externally, you must first write to Liverpool City Council and ask them to look at the decision again. This is the mandatory first step — skip it and the tribunal will send you back.

The deadline is one calendar month from the date on your decision notice. Not the date you received it — the date printed on the letter.

You can also request a written Statement of Reasons, which forces the council to explain exactly how they calculated your award. Asking for this extends your one-month deadline by however many days the council takes to send it. So if the Statement of Reasons takes 10 days to arrive, your deadline extends by 10 days.

Send your request to: Transactional Services, Cunard Building, Water Street, Liverpool, L3 1AH. You can also submit it through the council's online contact form, but always keep a copy and note the date you sent it.

In your letter, be specific about what you think is wrong. "I disagree with the decision" isn't enough. State which part of the calculation you're challenging — was it the income band assessment, a non-dependant deduction, the refusal to backdate, or something else? Attach any evidence that supports your case.

Stage 2: Valuation Tribunal for England

If Liverpool City Council either maintains its original decision or fails to respond within two calendar months of receiving your reconsideration request, you have the right to appeal to the Valuation Tribunal for England (VTE).

The VTE is an independent judicial body — not part of Liverpool City Council, not part of the DWP. It exists specifically to settle disputes between taxpayers and councils over council tax matters, including Council Tax Reduction calculations.

Your deadline to lodge the VTE appeal is two months from:

  • The date on the council's response letter (if they responded), or
  • The date the council's two-month response window expired (if they didn't respond)

You can submit your appeal through the VTE's online portal or by post to Valuation Tribunal Service, Ground Floor, Fry Building, 2 Marsham Street, London, SW1P 4DF.

Appeals to the VTE are completely free. You don't need a solicitor, though Citizens Advice Liverpool (0300 330 1196) can help you prepare. Liverpool City Council's own Benefits Advice Team also offers tribunal representation — request a referral through liverpool.gov.uk/benefits/advice-and-support/benefits-advice/.

What to Include in Your Appeal

The tribunal wants facts and evidence, not emotional arguments:

  • A copy of the decision notice you're challenging
  • A copy of your written reconsideration request and the council's response (if any)
  • Your calculation of what you believe the correct award should be, showing the income figures and band you think applies
  • Any evidence the council didn't have or didn't consider — payslips, bank statements, medical documentation for backdating claims

Common Grounds for Appeal

  • The council placed you in the wrong income band (miscalculated your net monthly earned income)
  • Household extensions for your partner or children weren't applied
  • A non-dependant deduction was applied incorrectly (wrong amount or wrong person)
  • Backdating was refused without properly considering your good cause evidence
  • The Minimum Income Floor was applied during your start-up period
