How to Appeal a Wirral Council Tax Reduction Decision
Step 1: Check the Decision Notice
When Wirral Council calculates or revises your Council Tax Reduction, they send a formal Decision Notice alongside a revised council tax bill. Before appealing, read the notice carefully. It should show which income band you have been placed in, the assessed net income figure, any non-dependant deductions, and the percentage discount applied.
Common errors worth checking:
- Wrong income figure — does the assessed net income match your actual earnings after tax, NI, pension contributions and the £20 disregard?
- Missing disregards — was PIP, DLA or another disregarded benefit incorrectly counted as income?
- Wrong household category — were you assessed as a couple when you are single, or vice versa?
- Non-dependant deduction applied incorrectly — was a deduction made for someone who should be exempt?
If the calculation looks wrong, the fastest route is often a phone call to the revenues team asking them to check. Simple errors can be corrected without a formal dispute.
Step 2: Internal Review (Section 16 Grievance)
If a phone call does not resolve it, the formal route starts with a written grievance under Section 16 of the Local Government Finance Act 1992. You must submit this within one month of receiving the decision notice.
The grievance goes to Wirral Council's Revenues and Benefits Appeals Team. It needs to state the specific grounds — which part of the calculation you believe is wrong and why. Attach any evidence that supports your case: payslips showing different earnings, UC statements showing disregardable elements that were counted, or medical evidence confirming a disability benefit the council missed.
The council has two calendar months to review your grievance and issue a written response. During this period, they may recalculate your award, uphold the original decision, or reject the grievance entirely.
Step 3: Valuation Tribunal for England
If the council's internal review does not go your way — or if they fail to respond within the two-month window — you can appeal to the Valuation Tribunal for England (VTE). The deadline is two months from the date of the council's final written decision, or two months from the date their response window expired.
The VTE is an independent judicial body. Appealing is free and you can represent yourself. Citizens Advice Wirral can also help you prepare. The tribunal evaluates whether Wirral Council correctly applied its own 2026/27 scheme rules to your circumstances.
One important limitation: the VTE cannot change Wirral's scheme rules. If you disagree with the 50% cap itself or the Band D property restriction, the tribunal has no power to override those — they are policy decisions made by the council under its statutory authority. The VTE only considers whether the rules were applied correctly to your case.
Appeals are heard through written representations, remote video hearings, or in-person tribunals. The VTE does not award costs against unsuccessful appellants, so there is no financial risk to appealing.

Keep Paying While You Appeal
Filing a grievance or tribunal appeal does not suspend your duty to pay council tax. You must continue paying the amount shown on your current demand notice throughout the process. If the appeal succeeds and you have overpaid, the credit will be applied to your account.
Falling behind on payments while waiting for an appeal outcome can trigger recovery action — liability orders, attachment of earnings — which creates a separate problem on top of the original dispute.
