How to Appeal a Wigan Council Tax Reduction Decision: Internal Review and Valuation Tribunal

When to Appeal

You have the right to challenge a Wigan Council Tax Reduction decision if you believe the council has applied its scheme rules incorrectly to your circumstances. Common grounds include:

  • The council miscalculated your income or applied the wrong earnings disregard
  • Capital was assessed using incorrect figures or a missing exemption
  • Your household was placed in the wrong tier (standard working-age when you had a child under five)
  • A non-dependant deduction was applied when an exemption should have covered it (e.g. you receive PIP daily living)
  • The council failed to account for a relevant change in circumstances

An appeal challenges how the rules were applied, not whether the rules themselves are fair. You cannot appeal against Wigan's 80% cap or zero-backdating policy — those are local scheme parameters, not individual assessment decisions.

Step 1: Request an Internal Review

Before going to an independent tribunal, you must first raise the dispute directly with Wigan Council. This is a formal written challenge under Section 16 of the Local Government Finance Act 1992.

What to include:

  • Your name, address, and Council Tax reference number
  • The specific decision you're challenging and the date on the notice
  • Clear grounds: exactly what you believe the council got wrong, with reference to specific figures, deductions, or household facts
  • Supporting evidence: updated payslips, bank statements, benefit letters, or medical evidence that contradicts the council's assessment

How to submit:

  • Use Wigan Council's online appeals form at wigan.gov.uk
  • Or send by post to: Customer Support, PO Box 100, Wigan, WN1 3DS

The deadline: The council must respond within two calendar months. While the review is ongoing, you must continue paying your Council Tax as billed. The appeal does not pause your payment obligation.

If the council agrees with your challenge, they issue a revised demand notice with the corrected figures. If they disagree, they send a written decision explaining why they're maintaining the original assessment.

Step 2: Appeal to the Valuation Tribunal

If the internal review fails — or if the council doesn't respond within two months — you can escalate to the Valuation Tribunal for England (VTE). The VTE is an independent statutory tribunal, completely separate from Wigan Council.

Filing deadlines are strict:

  • If the council issued a decision: you have two months from the date on the council's decision letter to submit your VTE appeal
  • If the council failed to respond: you have four months from the date you originally submitted your challenge to the council

If you miss a deadline, the Tribunal may accept a late appeal where circumstances beyond your control caused the delay. Contact it promptly, explain why the appeal is late, and do not assume an extension will be granted.

The VTE appeal is free. There is no filing fee. Appeals are typically heard via remote video hearing or written representations — you don't need to travel to a physical tribunal building.

What the VTE can and cannot do:

  • It can rule that Wigan Council applied its scheme rules incorrectly and order a recalculation
  • It cannot change the scheme's rules (the 80% cap, the capital limits, or the backdating policy)
  • It cannot award compensation or costs
  • Its decisions are binding on both you and the council

How to Write an Effective Appeal

Focus on facts and figures, not emotions. The council and the VTE respond to evidence, not hardship narratives.

Structure your appeal around:

  1. The specific decision — quote the date and the figures from the council's notice
  2. The error — identify precisely what the council calculated wrong, with your own figures
  3. The evidence — attach documents proving your version (payslips showing different income, bank statements showing different capital, benefit letters showing entitlement to a disregard)
  4. The correct outcome — state what you believe the award should be and why

Avoid general complaints about the system, references to other councils' schemes, or arguments that the rules are unfair. The tribunal only considers whether the existing rules were correctly applied to your case.
