Sandwell Council Tax Reduction Appeal — How to Challenge a Decision

The Two-Step Appeal Process

If Sandwell Council makes a Council Tax Reduction decision you believe is wrong — the income band placement, the capital calculation, a non-dependant deduction, the start date, or the application of the Band B cap — you have a statutory right to challenge it. The process has two stages: an internal written grievance, then an independent tribunal appeal if needed.

You must follow them in order. You can't skip straight to the tribunal.

Step 1: Formal Written Grievance to the Council

Under Section 16 of the Local Government Finance Act 1992, submit a formal written grievance to Sandwell Council explaining why the decision is incorrect in fact or law.

You can submit through the MySandwell portal at my.sandwell.gov.uk or by post to the Revenues and Benefits Division. Your grievance should specify:

  • Which part of the decision you're challenging (the income band, the capital assessment, the start date, a missing discount)
  • Why you believe it's wrong (your actual income figure, evidence of capital below the threshold, proof of a child under six, documentation the council didn't consider)
  • What outcome you're seeking

The council has two months from receipt to review the determination and issue a formal written response. During this period, keep paying your council tax instalments as billed. Lodging a grievance doesn't pause enforcement.

Step 2: Valuation Tribunal for England (VTE)

If the council rejects your grievance, or if two months pass without any response, you can appeal to the Valuation Tribunal for England. The VTE is an independent judicial body — it's not part of Sandwell Council.

Deadlines: You have two months from the date of the council's response to file with the VTE. If the council never responded, you have four months from the date you originally submitted the written grievance.

The VTE has the power to direct Sandwell Council to recalculate your CTR award or correct decision parameters. If it finds the council misapplied its own scheme rules or statutory regulations, it can order a fresh determination.

What the VTE can't do: It cannot alter the lawful terms of Sandwell's adopted scheme. The tribunal cannot overturn the 85% cap, remove the Band B restriction, or raise the £3,000 capital limit. These are policy decisions made by Full Council, not administrative errors.

What's Worth Appealing

Focus your appeal on factual disputes where you have evidence:

  • Income band misplacement — your payslips show net weekly income of £95 but the council assessed you at £100, putting you in a lower discount tier
  • Capital miscalculation — savings counted that should have been excluded (a pension fund, your main home's equity)
  • Missing non-dependant exemption — you receive PIP daily living but the council applied a non-dependant deduction for your adult child
  • Wrong start date — you contacted the council before submitting the form but the claim was dated from submission, not initial contact
  • Household composition error — a child under six wasn't reflected in the calculation

Payment During Appeals

This is non-negotiable. Whether you're at the written grievance stage or the VTE stage, you must continue paying the council tax instalments on your latest demand notice. If the appeal succeeds, Sandwell credits your account and refunds any overpayment.

Missing payments during an appeal triggers the same enforcement path as any other non-payment — reminder notices, loss of instalments, court summons.

Section 13A Discretionary Refusals Are Different

If Sandwell refuses a Section 13A(1)(c) discretionary hardship application, the VTE has no jurisdiction. The only route to challenge discretionary refusals is judicial review in the High Court, which requires specialist legal advice and is typically a last resort.
