How to Appeal a Council Tax Reduction Decision in West Northamptonshire

When You Can Appeal

You can challenge a Council Tax Reduction decision if WNC has refused your claim, calculated your award incorrectly, rejected a backdating request, or turned down a hardship application. The process has two formal stages, and you must start with Stage 1 before going to the tribunal.

Stage 1: Written Grievance to WNC

Submit a formal written grievance directly to West Northamptonshire Council within one calendar month of the date on your decision notice.

Your grievance must be in writing — either by post or email to [email protected]. Phone calls to WNC staff do not count and do not preserve your appeal deadlines. If you only discuss your concerns by phone, the clock keeps running.

The grievance should:

  • State clearly that you are making a formal grievance under Section 16 of the Local Government Finance Act 1992
  • Identify the specific decision you're disputing (include the decision notice date and reference)
  • Explain exactly what you believe is wrong — which income figure is incorrect, which deduction was miscalculated, why the backdating refusal is unjustified
  • Attach any evidence that supports your position

WNC then has two calendar months to review your grievance and issue a formal written response.

Stage 2: Valuation Tribunal for England (VTE)

If WNC rejects your grievance — or fails to respond within two months — you can escalate to the Valuation Tribunal for England. The VTE is an independent statutory body that determines disputes about Council Tax Reduction.

Deadlines for lodging a VTE appeal:

  • If WNC issued a written response to your grievance: within 2 months of that response date
  • If WNC did not respond at all: within 4 months from the date you submitted your original Stage 1 grievance

VTE appeals are free to submit. Hearings are conducted remotely via web conference, and the tribunal issues a written decision with reasons within one month of the hearing.

VTE vs VOA: Know the Difference

The Valuation Tribunal handles disputes about your Council Tax Reduction entitlement — the means test, the award calculation, backdating, hardship decisions.

If your dispute is about your property's valuation band (whether your home should be in Band C instead of Band D, for example), that goes to the Valuation Office Agency (VOA), which is part of HMRC. Band challenges and reduction appeals are completely separate processes.

What to Include in Your Appeal

The strongest appeals are specific. Instead of "my award is too low," write "my decision notice shows assessed weekly income of £320, but my actual weekly income for the assessment period was £280 based on the attached payslips." Give the tribunal concrete figures to compare.

Request a written calculation breakdown from WNC if your decision notice does not include one. You are entitled to see exactly how your income, applicable amount, taper and deductions were worked out.

The Ombudsman Route

If your complaint is about WNC's handling of your case — delays, poor communication, failure to provide information — rather than the legal correctness of the decision itself, you can complain to the Local Government and Social Care Ombudsman (LGSCO). This is a separate route from the VTE and focuses on maladministration rather than legal entitlement.
