How to Appeal Lewisham Council Tax Reduction

When You Can Appeal

If Lewisham Council refuses your Council Tax Reduction claim, awards less than you expected, or miscalculates your entitlement, you have the legal right to challenge the decision. The process runs through two stages: an internal written grievance to the council, then an independent appeal to the Valuation Tribunal for England if the council doesn't resolve it.

Before jumping to a formal appeal, check your decision notice line by line. Common errors include the wrong income figure (often because the council used a UC payment from the wrong month), a missing earnings disregard, or a non-dependant deduction that shouldn't apply because the person has moved out.

Stage 1: Written Grievance to Lewisham Council

Under Section 16 of the Local Government Finance Act 1992, you submit a written notice to Lewisham Council's benefits team. Your letter must state the specific grounds — not just "I disagree" but exactly which part of the calculation is wrong and why.

Effective grievance letters include:

  • The decision date and your council tax reference number
  • The specific figure you're challenging (income assessment, taper deduction, non-dependant deduction)
  • The evidence showing the correct figure (payslips, UC breakdown, proof the non-dependant has moved)
  • What outcome you want (recalculation, reinstatement, backdating)

The council's target is to respond within 28 working days. If they agree with you, they'll issue a revised decision and adjust your council tax account. If they uphold the original decision, they'll explain why in writing.

Stage 2: Valuation Tribunal for England

If the council upholds the decision or doesn't respond within two calendar months, you can escalate to the Valuation Tribunal for England (VTE). The appeal is filed online at valuationtribunal.gov.uk and is completely free.

Key deadlines:

  • Filing window: within two months of the council's written response, or within two months from when their two-month response window expired
  • Hearing: the VTE schedules a panel hearing where both you and the council present your case
  • Outcome: the tribunal's decision is binding — if they rule the council got the calculation wrong, the council must recalculate

The VTE can determine whether Lewisham correctly applied its own scheme rules. It cannot strike down the 75% maximum award cap or change the scheme itself — those are policy decisions made by Full Council.

What the Tribunal Cannot Do

The VTE handles legal calculation disputes. If your complaint is about how the council treated you — unreasonable delays, lost documents, unhelpful staff — that goes to the Local Government and Social Care Ombudsman instead. The Ombudsman investigates maladministration but can't change a benefit decision.

Keep Paying While You Appeal

You must continue paying your council tax throughout the grievance and appeal process. Withholding payment because you've lodged an appeal doesn't pause enforcement. The council can still issue reminders, apply for a liability order at the magistrates' court, and pass the debt to enforcement agents while your appeal is pending.

If the appeal succeeds and you've been overpaying, the excess is credited back to your council tax account.

The Lewisham Council Tax Reduction guide includes a decision notice audit worksheet for checking every line of the council's calculation, plus template wording for a Section 16 written grievance.
