How to Appeal a Council Tax Reduction Decision in Wandsworth

When You Can Challenge a Decision

You have the right to challenge any Council Tax Reduction decision Wandsworth makes about your claim — a refusal, a lower award than expected, a backdating rejection, or a decision to reduce or end your existing award after a change of circumstances.

The process has two stages with strict deadlines. Missing either deadline means losing that route.

Stage 1: Local Review (One-Month Deadline)

Within one calendar month of receiving the decision notice, you can ask Wandsworth Council to review the decision internally. This is sometimes called a reconsideration or mandatory review.

Write to the Benefits Service (by email to [email protected] or by letter) and state:

  1. Your council tax account number and claim reference
  2. Which decision you are challenging and its date
  3. Why you believe the decision is wrong — be specific (e.g., "my capital was assessed at £6,200 but my March bank statement shows £5,840 after a direct debit cleared on 28 February")
  4. Any new evidence the original decision did not consider

This is your chance to add evidence you could not provide the first time: an updated bank statement, a benefit award letter that arrived late, or a GP letter for a backdating request.

The council must review the decision and issue a written reply within two months. If it rejects your grievance, you can appeal to the Valuation Tribunal for England. If it has not replied within two months, you can also appeal.

Stage 2: Valuation Tribunal for England (Two-Month Deadline)

If the council rejects your grievance, lodge your appeal with the Valuation Tribunal for England (VTE) within two months of the council's final decision notice. If the council does not reply within two months, you can appeal within two months after that response deadline passes.

The VTE is an independent tribunal. It does not work for Wandsworth Council or any government department. The appeal is free.

You submit an appeal online through valuationtribunal.gov.uk or by post. The form asks you to set out the grounds of your appeal — the factual or legal reasons you believe the council got it wrong.

A VTE hearing is usually held in person or by video. You can represent yourself, bring a friend or family member, or ask a Citizens Advice adviser or solicitor to speak on your behalf. Wandsworth Council sends a presenting officer who explains the council's position.

The tribunal's decision is binding. If it rules in your favour, Wandsworth must recalculate your CTR award.

Common Grounds for Challenge

Incorrect scheme level. The council placed you in Scheme 5 (75% reduction) when your Carer's Allowance award should have triggered Scheme 1 (100%), provided your earned income remained below the applicable Scheme 4 or Scheme 5 cap. This can happen when benefit evidence is missing or misread.

Wrong income calculation. The council included income that should have been disregarded — childcare costs not deducted, the lone parent £25 disregard not applied, or statutory earnings disregards miscalculated.

Capital assessed too high. The council counted your main home as capital, or used a bank statement that does not reflect the relevant balance.

Backdating refused without proper consideration of good cause. You provided evidence of illness, bereavement, or misdirection and the council dismissed it without explanation.

Practical Tips

Keep copies of everything you send. Date-stamp your correspondence. If you email, request a read receipt or follow up the next day to confirm it was received.

The one-month deadline runs from when you receive the decision notice. The two-month appeal deadline runs from the council's final decision notice, or from the date its two-month reply period ends if it has not responded. Open council post promptly and keep a record of when notices arrive.

Continue paying whatever council tax remains due while the challenge is in progress. An appeal does not suspend your liability — if the tribunal later rules in your favour, any overpayment gets credited back to your account.

The Wandsworth Council Tax Reduction guide includes a dispute timeline planner that tracks the one-month and two-month deadlines and a template for structuring your review request.
