Council Tax Reduction and Housing Benefit: Are They the Same Claim?

They Used to Be One Claim — They Are Not Any More

Before April 2013, Housing Benefit and Council Tax Benefit were administered together by local councils, often on a single application form. When the national Council Tax Benefit was abolished and replaced by localised Council Tax Reduction schemes, the two became separate entitlements with separate rules. Housing Benefit is still governed by national DWP regulations. Council Tax Reduction is governed by each council's own local scheme under the Local Government Finance Act 1992.

Some councils still let you apply for both on the same form, and a few online portals combine them into a single process. But they are assessed independently, and being awarded one does not guarantee the other. The income thresholds, capital limits and deduction rules can differ between the two.

If You Are on Universal Credit

Universal Credit replaced Housing Benefit for most working-age claimants. The housing costs element within UC covers rent, so you no longer need a separate Housing Benefit claim from the council. However, UC does not cover council tax at all. You still need to apply for Council Tax Reduction directly with your local billing authority.

This is the single biggest source of missed CTR entitlement in England. The DWP sends an electronic notification to your council when you claim UC, but that notification is not an application for CTR. It is an alert that triggers the council to invite you to apply — if the council acts on it at all. Many councils do not follow up, and the householder ends up paying the full council tax bill while assuming UC has it covered.

If you have recently moved onto Universal Credit and have not separately applied for CTR, do it now. Most councils allow you to backdate CTR by one month from the date you apply (some allow longer), so the sooner you act, the less support you lose.

If You Are Still on Legacy Benefits

A smaller number of working-age claimants remain on legacy benefits — Income Support, income-based JSA, or income-related ESA — and still claim Housing Benefit directly from the council. If you are in this group, your council likely processes both Housing Benefit and CTR together, and a single change report updates both awards.

This arrangement ends when you are migrated to Universal Credit. The DWP's managed migration programme is in its final phase during 2026/27, and migration notices give you three months to claim UC. When you do, your Housing Benefit stops (replaced by UC housing costs), while Council Tax Reduction remains a separate local-council claim. The DWP's migration data may prompt a reassessment, but it does not itself make a new CTR claim. Check with your council whether you need to submit a new application or provide updated evidence.

Transitional Protection

If your total benefit income would drop as a result of managed migration, your UC award may include a Transitional Protection element to prevent immediate cash loss in your UC award. It does not automatically protect your Council Tax Reduction: working-age CTR schemes are local, and councils differ in how they treat this element. Check your council's scheme and ask it to explain how the element was counted before challenging the decision.

What to Do

If you currently receive Housing Benefit, check whether your council assesses CTR on the same form or requires a separate application. If you are on Universal Credit, confirm that you have an active CTR claim — and if you have not applied, do so immediately.

The Council Tax Reduction in England guide includes a Universal Credit Cross-Check and Follow-Up Log that tracks the dates of your UC claim, the council's notification, and your separate CTR application — so you have a clear record if something goes missing between the DWP and your billing authority.
