Cornwall Council Tax Support and Housing Benefit — How the Two Work Together

Council Tax Support and Housing Benefit are both administered by Cornwall Council, but they cover different things. Housing Benefit pays towards your rent. Council Tax Support reduces your council tax bill. You can claim both, and one doesn't replace the other — but the rules depend on whether you're on Universal Credit or legacy benefits.

If You're on Universal Credit

Universal Credit replaced Housing Benefit for most working-age claimants. For most people, rent help comes through UC's housing costs element, paid by the DWP as part of the monthly UC payment. Some people, including those in supported or temporary housing and people of State Pension age, may still need to claim Housing Benefit while receiving UC.

Council Tax Support is completely separate. UC does not include council tax help. You must apply directly to Cornwall Council through its online portal if you may qualify; a UC claim alone does not reduce your council tax bill.

When Cornwall Council calculates your Council Tax Support, the UC housing element is disregarded as income. The council doesn't count your rent help as money coming in, so it won't reduce your CTS award.

The UC childcare element is similarly offset by a childcare earnings disregard (up to £175 per week for one child, £300 for two or more). And any UC disability elements (LCW or LCWRA) trigger higher Applicable Amount baselines in the CTS assessment, which means more support.

If You're Still on Legacy Benefits

Some households haven't migrated to Universal Credit yet and still receive legacy Housing Benefit alongside income-based ESA, JSA, or Income Support. If that's your situation:

  • You claim Housing Benefit and Council Tax Support through Cornwall Council (same department, same portal)
  • The means test is similar for both but they're assessed as separate awards
  • Your Housing Benefit award doesn't reduce your CTS entitlement

Cornwall Council is one of the local authorities that processes both claims together when you apply, so a single application can generate two separate awards — one for rent, one for council tax.

DWP Managed Migration

If the DWP is migrating you from legacy benefits to Universal Credit, any Transitional Protection payments in your UC award are disregarded as income in Cornwall's CTS calculation. This prevents an immediate drop in your council tax support just because of the administrative switch.

For most working-age claimants, once migration to UC is complete, Housing Benefit stops and rent help moves into the UC housing costs element. Some people can continue to get Housing Benefit while on UC. Your Council Tax Support claim stays with Cornwall Council; report changes to the council separately.

The Key Takeaway

Whatever benefit system you're on, council tax help requires a direct claim to Cornwall Council. It's never included automatically in UC or Housing Benefit. And the housing-related income from either source doesn't count against you in the CTS assessment.

The Cornwall Council Tax Reduction guide walks through the full application process, including which UC elements affect the calculation and which are disregarded.
