Council Tax Overpayment Recovery in West Northamptonshire
How Overpayments Happen
A Council Tax Reduction overpayment occurs when WNC has given you more reduction than you were entitled to. The excess is added back onto your Council Tax account as a debt. Common causes:
- Late reporting of a change of circumstances: your income increased, a non-dependant moved in, or your savings crossed the £16,000 threshold, and you did not notify WNC within 21 days
- DWP data catch-up: WNC receives updated Universal Credit or benefit data from DWP showing a higher income than previously assessed
- Reassessment after review: WNC reviews your claim (often prompted by a periodic fraud check or data-matching exercise) and finds the original award was too high
- Error by WNC: the council miscalculated your award — this does happen, and it matters for your rights
The overpayment runs from the date the change actually occurred (or the date the error began), not the date WNC discovered it. A change of circumstances that happened six months ago and was only reported now creates six months of overpayment.
How WNC Recovers the Debt
WNC recovers the overpayment by adjusting your Council Tax account. This can increase your monthly instalments to cover both the ongoing (reduced) liability and the historic overpayment.
You will receive a revised Council Tax demand bill showing the new instalment amounts. The overpayment is treated as part of your Council Tax debt, which means WNC can use the same enforcement powers (reminders, court summons, liability orders) if you fail to pay.
Challenging an Overpayment
If you believe the overpayment is wrong — for example, the amount is incorrect or WNC used an incorrect figure — you have the right to challenge the decision.
Step 1: Request a full calculation breakdown. Write to [email protected] asking for the decision notice and a detailed written explanation of how the overpayment was calculated: the dates, the income figures used, and the difference between what was paid and what should have been paid. WNC's decision notice sets out the assessed income, capital, applicable amount, non-dependant deductions, award, effective date, and review and appeal rights.
Step 2: Submit a formal written grievance. If the breakdown reveals an error — wrong income figures, wrong dates, or a change that was in fact reported on time — submit a written grievance to WNC within one calendar month of the decision notice. State exactly which figures you dispute and attach your evidence (copies of emails proving timely reporting, payslips showing the correct income, etc.).
Step 3: Escalate to the Valuation Tribunal. If WNC upholds the overpayment and you still disagree, you can appeal to the Valuation Tribunal for England. The Tribunal is free to use and independent of the council.

When WNC Made the Error
If the overpayment followed a WNC mistake — for example, the council entered the wrong income figure or failed to process a change you reported on time — ask WNC to review the calculation. A Council Tax Reduction overpayment is treated as a reversal of the reduction, increasing the Council Tax owed; the Housing Benefit rule that can make an official-error overpayment non-recoverable does not apply to Council Tax Reduction. If you disagree with WNC's decision, use the written grievance process above and include evidence of the mistake and any reports you made.
In practice, WNC may still attempt recovery, arguing that you should have noticed your bill was too low. If this happens, challenge it formally. The Local Government and Social Care Ombudsman upheld a complaint against WNC for failing to provide requested Council Tax Reduction calculations and recommended a breakdown that let the claimant understand the figures used.
If You Cannot Afford the Increased Instalments
An overpayment recovery that pushes your monthly payments beyond what you can afford does not change your Council Tax Reduction entitlement going forward. But it does create a practical problem: a bill you cannot pay.
Contact WNC to request a longer repayment period. Councils have discretion over how quickly they recover overpayments, and spreading the amount over more months keeps your instalments manageable.
If even the forward-looking bill (without the overpayment) is unaffordable, check whether your Council Tax Reduction has been recalculated correctly for your current circumstances. A drop in income that triggered the overpayment investigation may also mean you are now entitled to a higher award.
If you are falling into arrears because of the overpayment recovery and cannot manage payments, seek free debt advice from StepChange (0800 138 1111), National Debtline, or Citizens Advice before the council escalates enforcement.
