Council Tax Arrears and Enforcement in West Northamptonshire: What Happens Next

The Enforcement Timeline

When you miss a council tax payment in West Northamptonshire, the process follows a fixed legal sequence. Understanding each stage helps you act before things escalate.

Stage 1 — Reminder notice. If you fall behind with an instalment, WNC sends a reminder giving you seven days to pay. If you do not pay within those seven days, you lose the right to pay by instalments and the full amount on your account becomes due immediately.

Stage 2 — Court summons. If you do not pay your Council Tax, WNC can issue a court summons asking the Magistrates' Court for a liability order. The summons demands the full amount owed plus £100 in costs.

Stage 3 — Liability order. You may attend the hearing and provide evidence that you are not liable for the debt. If you have no valid defence, the court will grant a liability order. A liability order gives WNC legal powers to recover the debt.

Stage 4 — Enforcement action. If you have no payment arrangement after a liability order, WNC writes to invite you to offer one. If 14 days pass without an offer, WNC can take enforcement action, including deductions from wages or benefits, referral to enforcement agents (bailiffs), or, in certain cases, bankruptcy or a charging order. Committal is considered only after enforcement agents have been tried and other efforts have failed.

What a Liability Order Means for You

A liability order does not make you a criminal — council tax debt is a civil matter. But the order unlocks recovery powers that WNC cannot use without it, including:

  • Instructing enforcement agents to attend your home and seize goods
  • Asking your employer to deduct arrears from your wages
  • Applying to DWP for direct deductions from Jobseeker's Allowance, Income Support, income-related Employment and Support Allowance, Pension Credit, or Universal Credit
  • Registering a charge against your property

For enforcement passed to agents on or after 1 May 2026, the compliance fee is £79. An enforcement visit adds £247 plus 7.5% of the amount over £1,900. These fees escalate quickly.

If You Receive a Court Summons

Don't ignore it. Contact WNC's revenues team at [email protected] as soon as possible. WNC will ask the court for a liability order; payment arrangements do not replace a valid defence at the hearing.

At the hearing, you can attend and provide evidence of why you are not liable, but you do not have to attend. If you have no valid defence, the court will grant the liability order. If you have no payment arrangement after the order, WNC will write to invite you to offer one; enforcement can follow if you make no offer within 14 days.

Getting Free Help Immediately

If you're facing enforcement action, a PDF guide cannot fix this — you need specialist debt advice, and it's free:

  • StepChange — 0800 138 1111 (Mon–Fri 8am–8pm, Sat 9am–2pm), or online at stepchange.org
  • National Debtline — 0808 808 4000 (Mon–Fri 9am–8pm, Sat 9.30am–1pm)
  • Citizens Advice West Northamptonshire — cencab.org.uk (telephone appointments Mon–Thu, 9am–1pm)

These organisations can negotiate directly with WNC on your behalf, and they can help you apply for a "breathing space" — legal protections for up to 60 days that pause most enforcement action on included debts while you get advice. Ongoing Council Tax bills still have to be paid.

Preventing Arrears Through Council Tax Reduction

Many residents in arrears actually qualify for Council Tax Reduction but haven't applied. WNC's working-age scheme can reduce your bill by up to 80%, with a 20% minimum payment remaining. If you're on Universal Credit or a low income, a successful CTR claim reduces not just future bills but can prevent the spiral that leads to enforcement.

If your circumstances changed and you didn't report it within 21 days, WNC may recover any overpayment. The Exceptional Hardship Fund cannot cover recoverable LCTRS overpayments. WNC's fund has a £100,000 annual budget for residents who can't cover their remaining liability.

The Key Thing to Remember

Enforcement escalates when people do not respond. After a liability order, WNC invites a payment offer and can take enforcement action if none is made within 14 days. The worst outcome is doing nothing.
