Council Tax Band Appeal Rejected — What Next?

The VOA has looked at your challenge and said no. Your property stays in the same band. It's frustrating, but the rejection isn't necessarily the end — what happens next depends entirely on what type of challenge you made.

Check What Type of Rejection You Received

This is the first and most important question. The VOA issues two different documents after a rejected challenge, and your options are completely different depending on which one you got.

A Decision Notice means the VOA considered your formal proposal on its merits and decided the band is correct. You have three months from service of that notice to appeal to the Valuation Tribunal for England (VTE).

An Invalidity Notice means the VOA rejected your proposal on procedural grounds — you submitted it outside the six-month window, you didn't have standing to make it, or the form was incomplete. You have four weeks from service to appeal the invalidity itself to the VTE.

An informal rejection letter (no formal notice heading) means the VOA reviewed your band informally and decided not to change it. This carries no statutory right of appeal. You can't take an informal rejection to the tribunal unless the VOA formally alters the list or issues a formal notice.

If You Got a Decision Notice: Appeal to the VTE

The Valuation Tribunal is free, independent, and specifically designed to hear these disputes. The VOA's rejection is not the final word — it's the VOA's opinion. The tribunal makes its own determination based on the evidence both sides present.

To appeal, submit the online form through the VTE portal within three months of service of the Decision Notice. You'll need:

  • The date of the Decision Notice
  • Your property address and current band
  • The band you believe is correct
  • A summary of why you disagree with the VOA's decision

For a banding appeal, the Valuation Office normally sends its evidence six weeks before the hearing, you send yours four weeks before, and the Valuation Office sends the combined bundle to the VTE two weeks before. The directions for your case set the deadlines. Hearings are normally remote.

If You Got an Informal Rejection

An informal rejection is harder to escalate, but not a dead end. Your options:

  1. Submit a formal proposal if you're still within the six-month window from becoming the taxpayer, or if a qualifying event has occurred (material change plus a relevant transaction like a sale).
  2. Ask the VOA to reconsider with new evidence. The VOA retains discretionary power under Section 24 of the LGFA 1992 to review bands at any time if presented with compelling evidence — but this route gives you no statutory appeal right.
  3. Understand who may have a new proposal window — a new taxpayer may have six months from becoming liable to make a proposal, subject to the rules on prior proposals. A sale does not reopen the former taxpayer's expired window.

Strengthening Your Evidence for the VTE

If the VOA rejected you, their Decision Notice usually explains why. Common reasons include insufficient comparables, relying on modern property values instead of 1991 data, or the VOA's own comparable analysis supporting the current band.

For the tribunal, you need to address those weaknesses directly:

  • More comparables: find additional properties of similar size, type, and age in lower bands on the same or nearby streets
  • Better 1991 evidence: Land Registry sale prices from 1989–1993, or post-1993 prices adjusted back to 1991 using the Nationwide or Halifax index
  • Floor area data: gross external area measurements from planning portal records, showing your property matches lower-banded comparables in size

The VTE assesses evidence on a "tone of the list" basis — if most similar properties in your area support your current band, a single lower-banded neighbour won't be enough.

Don't Miss the Deadline

Three months from service of a Decision Notice, or four weeks from service of an Invalidity Notice. Mark the service date and calculate the correct deadline for the notice you received.

For a late Decision Notice appeal, the VTE President may authorise it under regulation 10(3) of the Council Tax (Alteration of Lists and Appeals) (England) Regulations 2009 only if the failure to meet the deadline arose from circumstances beyond your control. If you have missed the four-week Invalidity Notice deadline, contact the VTE promptly rather than assuming an extension is available.

Our England Valuation Tribunal Appeal Guide includes a Dispute Route Classifier that identifies exactly which route applies to your rejection, plus an Evidence Index template for organising your comparable properties and 1991 valuation data before the hearing.
