VOA Rejected Your Council Tax Band Challenge: What to Do Next

A letter arrives from the VOA: your council tax band challenge has been rejected. The Listing Officer reviewed the evidence and decided the current band is correct. It feels like a dead end, but depending on how you submitted the challenge, you may have a clear next step.

Formal Proposal Rejection vs Informal Review Rejection

The first thing to check is which type of challenge you submitted:

Formal proposal (submitted within six months of becoming the taxpayer, within six months of a VOA band change, or following a qualifying physical change) — the VOA's rejection comes as a formal decision notice under Regulation 9 of the Council Tax (Alteration of Lists and Appeals) (England) Regulations 2009. This triggers a statutory right to appeal to the Valuation Tribunal for England (VTE).

Informal band review (submitted when no formal proposal ground applied) — the VOA's refusal does not carry an automatic right of VTE appeal. If the VOA says no after an informal review, your options are more limited.

Check the letter carefully. If it references a "decision notice" and cites the regulations, you submitted a formal proposal and can appeal.

Appealing to the VTE

If you submitted a formal proposal, you normally have three months from service of the VOA's decision notice to lodge an appeal with the VTE. The appeal is free, and the VTE is independent of the VOA.

The VTE will hear your case, review the evidence from both sides, and make its own determination. The VOA's rejection is not the final word — the tribunal can and does overturn Listing Officer decisions when the evidence supports a different band.

Lodge your appeal through the VTE's online portal. You need the decision notice, a statement of your case, and the band you believe is correct. Do not wait until the last week — three months passes quickly, and you may need to explain why you need an extension.

What If the VOA Never Responded?

If you submitted a formal proposal and the VOA did not issue a decision notice within the statutory four-month review period, you can appeal directly to the VTE. Your appeal window is three months from the date the four-month period expired.

This is an important safeguard: the VOA cannot defeat a formal proposal simply by ignoring it.

What If You Submitted an Informal Review?

An informal review rejection is harder to escalate. You do not have an automatic right to appeal to the VTE.

Your options:

  • Request a fresh review with stronger evidence — if you originally submitted weak comparators or relied on a house price calculator, a new submission with PAD data, corrected property measurements, or better comparators might get a different result.
  • Wait for a qualifying event — if you sell the property and the new owner is within their six-month window, they can submit a formal proposal. If a material change occurs (demolition, environmental change), that reopens the formal route.
  • Check for an invalidity notice — if the VOA issued an invalidity notice (saying your proposal did not meet the requirements of Regulation 4 or 5) rather than a substantive rejection, you have four weeks from service to appeal that invalidity to the VTE. If the VTE finds your proposal was valid, the VOA must reconsider it on the merits.

Strengthening Your Case for an Appeal

A VOA rejection is not necessarily a sign that your case is weak. It means the Listing Officer was not persuaded by the evidence as presented. Before the VTE, you have an opportunity to strengthen your submission:

  • Request the VOA's comparator data — the VOA must share the evidence it relied on. If their comparators are weaker than yours, that helps your case.
  • Add more comparators — if you originally provided two, try to find four or five. The closer they are to your property in type, size, age, and location, the stronger the case.
  • Get a professional survey — if floor area or property type is in dispute, a measured survey removes ambiguity.
  • Focus on the PAD — if the VOA's Property Attribute Data contains errors about your property, those errors undermine the banding decision.

Timelines Matter

The three-month appeal deadline is not flexible. Mark it on your calendar the day the decision notice arrives. If you need time to gather additional evidence, lodge the appeal first — you can continue building your evidence pack during the pre-hearing exchange period.

Our Challenging Your Council Tax Band guide includes step-by-step VTE appeal preparation, evidence bundle templates, and a timeline tracker for the key deadlines — so you are ready to escalate from day one if the VOA says no.
