Valuation Tribunal for Wales: How to Appeal a Council Tax Band Decision

What the VTW Is

The Valuation Tribunal for Wales is an independent judicial body — separate from the VOA, separate from your council, and funded by the Welsh Government. It resolves disputes about council tax banding, liability, discounts, exemptions and the Council Tax Reduction Scheme across all 22 Welsh billing authorities.

Its main office is in Newport, but hearings happen at regional venues across Wales and by video conference. Tribunal proceedings are free. No filing fees, no court costs, and the VTW cannot award costs against you if you lose.

When You Can Appeal

You don't walk straight into the tribunal. The VTW hears appeals only after a formal process has run its course:

Banding appeals — If the VOA rejects your formal statutory proposal (or fails to issue a decision within four months), you can appeal to the VTW. The deadline is four months from when the decision notice is provided, or from the expiry of the four-month window if no notice is issued.

Invalidity appeals — If the VOA declares your proposal invalid (wrong capacity, missed deadline, incomplete information), you can appeal that invalidity decision to the VTW within four weeks.

Liability and relief appeals (Section 16) — If your council refuses a discount, exemption, or CTRS claim, you serve a written grievance on the council. If the council rejects it or doesn't respond within two months, you can appeal to the VTW.

Since the February 2026 reforms, cases no longer transfer to the VTW automatically when the VOA runs out of time. You must lodge the appeal yourself.

How Hearings Work

The VTW offers three hearing formats:

  1. Remote digital hearings — by video conference, the most common format since the pandemic
  2. In-person hearings — before a two- or three-member lay panel at a regional venue, with a legally trained Clerk supporting the panel
  3. Written representations — the panel decides based entirely on documents, with no oral hearing; available when all parties consent

Most banding appeals involve you presenting your comparable evidence and the VOA's representative presenting theirs. The process is less formal than a court, but it is a structured proceeding with rules about evidence exchange, deadlines, and bundle submissions.

Preparing Your Evidence Bundle

The VTW expects a structured, indexed bundle containing:

  • Your notice of appeal and the VTW's acknowledgment
  • A statement of case setting out your grounds and legal arguments
  • A chronology covering the original proposal, VOA decision notice, and any correspondence
  • Your comparable evidence table with Land Registry sale records, VOA band entries, and floor plans
  • Photographs, maps, or planning documents where relevant

Bundles must be delivered to the VTW Clerk and the VOA within the directed timeframe — typically 14 to 21 days before the hearing date. Late evidence can be excluded under the 2025 procedural reforms.

Redact any personal sensitive data (financial records, third-party identities) before submitting.

What the Tribunal Can Do

The VTW panel evaluates the evidence and issues a written decision with full reasons. They can confirm your band, reduce it, or increase it. Yes — the tribunal can raise your band if the evidence supports it, though this is rare.

After the decision, the only onward route is an appeal to the High Court on a point of law — meaning the tribunal misapplied the legislation or reached a conclusion no reasonable tribunal could. Disagreeing with how they weighed your comparable evidence is not a point of law.

The Challenging Your Council Tax Band in Wales guide covers tribunal preparation in detail, including a hearing checklist, evidence bundle template, and guidance on presenting your case to the panel.
