Valuation Tribunal Council Tax Band Appeal: How to Take Your Case to the VTE
The VOA has rejected your council tax band challenge. You believe the evidence supports a lower band. The next step is an appeal to the Valuation Tribunal for England (VTE) — an independent judicial body that will hear your case, review the evidence, and make its own decision. The entire process is free.
Who Can Appeal and When
You can appeal to the VTE if you submitted a formal proposal under Regulation 4 of the Council Tax (Alteration of Lists and Appeals) (England) Regulations 2009 and the Listing Officer rejected it, or did not issue a decision within the four-month decision period.
The usual deadline is three months from service of the VOA's decision notice. If the VOA failed to issue a decision within its four-month review window, you can appeal within three months of that expiry date. The tribunal may extend the time limit in some circumstances; explain why you need an extension on the appeal form.
If you only requested an informal band review (because you were outside the six-month statutory window), and the VOA refused, you do not have a direct right of appeal to the VTE. This is one reason the formal proposal route matters.
How to Lodge an Appeal
Appeals are submitted through the VTE's online portal or by paper form. You need:
- Your name and contact details
- The property address
- A copy of the VOA's decision notice (or evidence that the four-month review window expired without a decision)
- A statement explaining why you believe the decision is wrong
- The band you believe your property should be in
The VTE acknowledges your appeal and registers it. Both you and the VOA Listing Officer are then bound by the tribunal's procedural timetable.
The Evidence Exchange Schedule
The VTE enforces strict deadlines for evidence sharing before the hearing. The typical schedule runs:
- 8–10 weeks before the hearing: the VTE issues a Notice of Hearing and procedural directions.
- 6 weeks before: the VOA must serve its formal evidence bundle on you — this includes the Listing Officer's valuation assessment, comparator data, and the reasoning behind the decision.
- 4 weeks before: you must send your counter-evidence, rebuttal statements, and any additional comparator data directly to the VOA.
- 2 weeks before: the VOA submits the combined, indexed hearing bundle to the VTE and provides you with a final copy.
Missing the 4-week deadline for your counter-evidence is serious. The VTE can exclude evidence submitted late, which leaves you arguing your case without your strongest material.

What Happens at the Hearing
Most VTE hearings are held remotely via Microsoft Teams, though you can request an in-person hearing at a tribunal venue. Written representations are also an option if both parties agree, but an oral hearing gives you the chance to respond directly to the VOA's arguments.
The hearing panel typically consists of two or three trained lay members, assisted by a qualified clerk. In some cases, a single professional Valuation Judge presides.
The burden of proof is on you. You need to demonstrate, on the balance of probabilities, that the VOA's band entry is incorrect. This means your comparator evidence, PAD data, and any historical sales records need to tell a clear story: properties that match yours sit in a lower band, and the 1991 valuation data supports that lower band for your property too.
You can represent yourself — most appellants do. You can also bring a professional surveyor or a lay representative to support you. There is no requirement for legal representation.
What the Tribunal Can Decide
The VTE has broad powers. It can:
- Reduce your band to the level you requested, or to a different band if the evidence supports it
- Maintain the current band if it finds the VOA's assessment was correct
- Increase your band if it concludes the property is actually under-banded (rare, but possible)
The VTE's decision is final on questions of valuation fact. Written reasons are issued within about a month of the hearing.
Beyond the VTE: High Court Appeals
If you believe the VTE made a legal error — misinterpreted the statute, followed an irrational procedure, or ignored relevant evidence — you can appeal on a point of law to the High Court (Administrative Court). The deadline is four weeks from the date the VTE decision notice is delivered. This is a legal avenue, not a second bite at the valuation evidence.
Preparing Effectively
The difference between winning and losing at the VTE usually comes down to evidence quality and organisation. A well-structured evidence bundle — with a clear comparator table, PAD data, historical sales records, and a concise statement of your case — makes the panel's job easier and your argument stronger.
Our Challenging Your Council Tax Band guide includes a VTE evidence bundle framework, timeline tracker for the evidence exchange deadlines, and hearing preparation notes — designed to take you from a VOA rejection to a tribunal-ready case.
