VTE Evidence Bundle for Council Tax Band Appeal: What to Include

If the VOA has rejected your council tax band proposal and you have lodged an appeal with the Valuation Tribunal for England, the next step is building the evidence bundle that will decide your case. The VTE is a formal tribunal — lay members assess your evidence against the VOA's, and the side with the stronger comparator data usually wins.

What Goes Into an Evidence Bundle

Your bundle is the complete set of documents you will rely on at the hearing. It should include:

A statement of case. A clear, factual summary of why you believe the 1 April 1991 value of your property falls within a different band. Name the band you are in, the band you believe is correct, and the evidence that supports the change. Keep it factual — the VTE is unimpressed by arguments about affordability or fairness.

Comparator schedule. This is the centrepiece. List two to four properties that are physically identical to yours (same type, same street or immediate locality, same approximate size) and currently sit in your target band. For each comparator, include the full address, current band, property type, and any available 1991-era sale price. The VOA Valuation List on GOV.UK gives you the band; HM Land Registry Price Paid Data gives sale prices from 1995 onwards (earlier transactions require archive searches).

Property Attribute Data (PAD). If you requested PAD from the VOA during the proposal stage, include the printouts for your property and each comparator. PAD shows floor area, number of rooms, property type, and structural characteristics — the raw data the VOA uses for banding. Discrepancies between your property's PAD and a higher-banded comparator's PAD strengthen your case.

Historical sale prices. Direct evidence of what your property or nearby identical homes sold for between 1989 and 1993 carries the highest weight. If you are relying on a more recent sale price adjusted backwards using a house price index, include the calculation — but be aware the VTE treats indexation as a rough guide, not primary evidence, because regional indices do not capture micro-locality price movements.

Photographs and plans. Photos of your property and your comparators showing physical similarity (or dissimilarity from properties in higher bands) can reinforce the written evidence. Floor plans or structural surveys are useful where physical dimensions are central to the argument.

The VOA's Decision Notice. Include the notice rejecting your proposal, so the panel can see the VOA's stated reasoning.

The Evidence Exchange Deadline

After your appeal is registered, the VTE issues directions setting a hearing date and evidence exchange dates. Typically, the VOA sends its bundle six weeks before the hearing; you send any counter-evidence four weeks before; and the VOA submits the combined, indexed bundle to the VTE and gives you a final copy two weeks before. This exchange is mandatory; evidence submitted on the day of the hearing without prior disclosure may be excluded.

The VOA will send you its own bundle, including the Listing Officer's comparator evidence and any property inspection notes. Read it carefully. If the VOA's comparators differ from yours in important ways (different property type, different street, structural differences), note these discrepancies for the hearing.

Preparing for the Hearing Itself

VTE hearings are conducted by a panel of two or three trained lay members (or a single Valuation Judge for complex cases), assisted by a clerk. They can be held in person, by video, or decided on written representations if both parties agree.

The hearing typically runs 30 to 60 minutes for a straightforward band dispute. You will be asked to present your case, the VOA presents its case, and each side can ask questions of the other. The panel may ask its own questions.

Practical preparation points:

  • Know your comparators cold. Be ready to explain why each one is a valid comparison and to address any differences the VOA raises.
  • Stick to 1991 values. Current market prices are irrelevant. Every argument should loop back to what the evidence says about 1 April 1991 values.
  • Bring spare copies. The panel and the VOA each need a copy of your bundle, so bring at least three sets to an in-person hearing.
  • You can bring a representative. You do not need a solicitor. A friend, family member, or professional surveyor can present on your behalf if you prefer.

What Happens After the Hearing

The VTE issues a written decision, usually within a few weeks. If the panel orders a band reduction, the VOA amends the Valuation List and the billing authority recalculates your account — including backdated refunds where applicable. If the panel upholds the existing band, the only further avenue is a High Court appeal on a point of law (not on valuation fact), which must be lodged within four weeks.

Our council tax band challenge guide covers the entire journey from first checking your band through to the tribunal, including evidence-gathering worksheets and a comparator schedule template.
