Council Tax Arrears Help in Milton Keynes: What to Do Before Bailiffs Arrive

If You Have Fallen Behind on Council Tax

Council Tax debt escalates faster than most other household debts. Milton Keynes City Council follows a statutory recovery process: first a reminder notice giving you 7 days to catch up, then a second reminder or final notice if you still have not paid, followed by a summons to the Magistrates' Court and a liability order. Once a liability order is granted, the council can instruct enforcement agents (bailiffs), apply for an attachment of earnings, or deduct directly from benefits.

The most important thing you can do at any stage is act quickly. The earlier you engage, the more options remain available.

Contact Free Debt Advice Immediately

This is not a situation where a guide can substitute for professional help. Council Tax debt carries unique enforcement powers that other creditors do not have, and navigating them requires specialist advice. Three national organisations provide free, confidential support:

StepChange Debt Charity — phone 0800 138 1111 or visit stepchange.org. StepChange can set up a structured debt management plan, negotiate with the council on your behalf, and help you access breathing space (the Debt Respite Scheme gives you 60 days of protection from enforcement while a plan is put in place).

National Debtline — phone 0808 808 4000 or visit nationaldebtline.org. National Debtline provides self-help packs, sample letters, and phone-based guidance tailored to Council Tax arrears specifically.

Citizens Advice Milton Keynes — phone the freephone Adviceline on 0808 278 7991 or visit miltonkeynescab.org.uk. Contact them for free advice about your options and the support available for your situation.

MK Money Lifeline — phone 0300 123 5198 for free community debt and money advice appointments in Milton Keynes.

What Happens at Each Stage

Reminder notice: the council sends this when you miss an instalment and gives you 7 days to catch up by paying the overdue amount. If you cannot, contact the council to arrange a payment plan before the next stage.

Court summons: the council applies to the Magistrates' Court for a liability order. Court costs may be added to your debt; check the amount shown on the summons. If you receive one, contact a free debt adviser promptly for help understanding the hearing and your options.

Liability order: once granted, the council gains enforcement powers. It can instruct enforcement agents (bailiffs), apply for an attachment of earnings (a deduction taken directly from your wages by your employer), or deduct from benefits. Enforcement fees may be added to the debt; ask a free debt adviser about the charges and your options.

Can Council Tax Reduction Help If You Are Already in Arrears

If you are behind on Council Tax but have not yet applied for Council Tax Reduction, apply immediately. A CTR award does not automatically write off existing arrears, but it is credited to your Council Tax account. You can request backdating for up to six months if you show continuous good cause; an award for an earlier period can reduce the balance on your account.

If you are already receiving CTR but cannot afford the remaining 20%, the council's Discretionary Council Tax Reduction Scheme (DCTRS) may cover the gap. This is a separate application that requires evidence of financial hardship and proof that you have sought debt advice.

Breathing Space: The Debt Respite Scheme

If you are in problem debt, ask a debt adviser whether you qualify for Breathing Space. A standard Breathing Space can pause most enforcement action, creditor contact, interest and charges on qualifying debts for up to 60 days while you get debt advice and make a plan. It does not write off the debt, and you should keep paying ongoing liabilities such as your current Council Tax bill where you can. StepChange or Citizens Advice can explain your options and how to apply.

The Bottom Line

Council Tax arrears need specialist help, not a PDF. Contact one of the free advice services listed above before enforcement reaches the next stage.

If you want to understand the Council Tax Reduction scheme itself — how to apply, what you might be entitled to, and how to combine it with discretionary hardship relief — the Milton Keynes Council Tax Reduction guide covers that process in full.
