Council Tax Arrears and Debt Help in Central Bedfordshire

The Enforcement Timeline for Council Tax Arrears

Council tax debt in Central Bedfordshire follows a fixed legal sequence. Understanding where you are in that sequence determines what options you have.

Stage 1 — Reminder notices. If you miss an instalment, Central Bedfordshire Council sends a reminder giving you seven days to bring the account up to date. CBC sends no more than two reminders before starting court proceedings.

Stage 2 — Final notice. If you continue to pay late, the council issues a final notice. At this point, the entire remaining annual balance becomes due immediately — you lose the right to pay in monthly instalments.

Stage 3 — Summons. If the balance isn't paid in full, the council sends a summons for a liability order hearing at the Magistrates' Court. The council adds £83 in court costs to your debt.

Stage 4 — Liability order. If the court grants the order, the council can use further recovery methods, including attachment of earnings (deductions from wages), deductions from eligible benefits, or referral to enforcement agents (bailiffs). It may also pursue a charging order on your property or committal proceedings in limited circumstances; imprisonment requires a court finding of wilful refusal or culpable neglect.

Stage 5 — Enforcement agents. If the council passes your debt to bailiffs, they can visit your home to collect payment or take control of goods. Enforcement agent fees are regulated and added to your debt: a compliance stage fee (£79), an enforcement stage fee (£247 plus 7.5% of the debt over £1,900), and a sale or disposal stage fee (£116 plus 7.5% of the debt over £1,900) if it reaches that point.

Your Rights at Each Stage

You are never powerless, even deep into the enforcement process:

  • Before the summons: Contact Central Bedfordshire Council to arrange a payment plan. The council has discretion to reinstate instalments or agree a repayment schedule. Call 0300 300 8000 or email [email protected].
  • At the summons stage: You can still pay the full balance (including costs) before the hearing to stop the process. You can also attend the hearing to explain your circumstances.
  • After a liability order: Contact the council immediately to negotiate a repayment arrangement. If you receive benefits, ask whether the council can use deductions from eligible benefits and whether it will pause any referral to enforcement agents.
  • When bailiffs are involved: Enforcement agents must give you at least 14 clear days' notice before taking control of goods. If a debt advice provider requests an extension for a non-business debt, the minimum notice period is 28 clear days. They cannot normally force entry on an initial visit to collect Council Tax, but may enter through an unlocked door or one you open. If you later breach a Controlled Goods Agreement, they can return to remove the goods and may use reasonable force to re-enter. You have the right to complain about bailiff conduct to the council and to the enforcement company.

Could You Be Claiming Council Tax Reduction?

A significant number of people who fall into council tax arrears are entitled to a reduction they haven't claimed. Central Bedfordshire's Council Tax Reduction scheme can cut your bill by up to 75% if you're on a low income or receiving Universal Credit.

Critically, claiming CTR is separate from your DWP benefits. Signing up for Universal Credit does not automatically register you for local Council Tax Reduction — you must apply directly to Central Bedfordshire Council at centralbedfordshire.gov.uk.

If you're already in arrears, applying for CTR won't wipe out existing debt, but it reduces your ongoing liability. You can also request backdating of your CTR claim for up to 12 months if you can show "good cause" for the delay — illness, hospitalisation, or being given incorrect advice by an official body. Simply not knowing about the scheme doesn't qualify as good cause.

For residents facing severe hardship, Central Bedfordshire also operates a discretionary relief fund under Section 13A(1)(c) of the Local Government Finance Act 1992. This is separate from the standard CTR scheme and can reduce or write off outstanding council tax in exceptional circumstances. You must have already applied for CTR and all other available discounts before the council considers a Section 13A application.

What Not to Do

Don't ignore the letters. Council tax is a "priority debt" in UK debt advice terms — it can lead to bailiff action, benefit deductions, or even committal proceedings faster than most other debts. Every stage you let pass without responding adds costs and removes options.

Don't pay a commercial debt management company to handle council tax arrears. The free services above do the same work at no cost, and some commercial firms charge fees that make your situation worse.

Our Central Bedfordshire Council Tax Reduction guide walks you through applying for CTR, backdating your claim, and structuring a Section 13A hardship application — all steps that can reduce your ongoing liability while you deal with existing arrears through the free debt advice services.
