Hillingdon Council Tax Arrears and Debt Help: Liability Orders, Bailiffs, and Free Advice
How Council Tax Arrears Escalate in Hillingdon
Missing a council tax payment in Hillingdon sets off a statutory collection process that moves faster than most people expect. After a missed instalment, the council sends a reminder and gives you seven days to bring payments up to date. If you do not, you lose the right to pay by instalments and the full year's balance becomes due. Hillingdon sends up to two reminders in a financial year; if you fall behind for a second time, it may send a second reminder before cancelling instalments.
If the full balance goes unpaid, Hillingdon Council applies to the Magistrates' Court for a liability order. This is a bulk hearing — the court processes hundreds of cases in a single sitting, and attendance by the debtor is optional. Hillingdon's current published costs are £130 for the summons and a further £20 if a liability order is made, £150 total.
A liability order gives the council new enforcement powers. These include instructing enforcement agents (bailiffs), making an attachment of earnings order with your employer, deducting money directly from certain benefits, or placing a charging order on your property. The council chooses the enforcement method — you don't get to pick.
What Bailiffs Can and Cannot Do
If Hillingdon Council passes your debt to enforcement agents, they must follow rules set out in the Taking Control of Goods Regulations 2013. The enforcement agent sends a compliance stage letter giving you at least seven days before a visit, with a £79 compliance fee. If you don't pay, they can visit your property.
On a first visit, bailiffs can enter through any door or gate that is already open, but they cannot force entry for council tax debt. They can list goods inside your home ("taking control") and return later to remove them if you still haven't paid. At the enforcement stage, the fixed fee is £247 plus 7.5% of the amount to be recovered above £1,900.
Certain goods are exempt from seizure: essential household items (beds, cookers, fridges, washing machines), tools of your trade up to £1,350, clothing, and items belonging to other people in the household. Bailiffs cannot take items that belong to someone else — if a family member owns something, it's protected.
Get Free Help Before It Escalates
Council tax debt is a "priority debt" — it can lead to bailiff action, deductions from wages, and in extreme cases a committal hearing in the Magistrates' Court. Getting advice early prevents most of the escalation.

Can CTR Reduce What You Owe?
If you owe arrears because you never claimed Council Tax Reduction, claiming now may reduce your current liability and, if you qualify for backdating, part of an earlier period. It does not automatically clear all existing arrears. Working-age backdating is limited to one month under Hillingdon's scheme rules, so the sooner you apply, the less you lose.
If your financial situation has worsened suddenly — job loss, illness, relationship breakdown — you may qualify for a discretionary reduction under Section 13A(1)(c) of the Local Government Finance Act 1992. This is Hillingdon's hardship fund, which can write off part of a council tax bill in exceptional circumstances.
The Hillingdon CTR guide covers both the standard reduction scheme and the Section 13A hardship application process. But if you're already facing enforcement action, contact one of the free advice services above first — they can help you deal with the immediate crisis while you sort out the longer-term claim.
