How to Appeal a Council Tax Reduction Decision in Bolton

When You Can Appeal

You have grounds to challenge a Bolton Council Tax Reduction decision if you believe the council made a calculation error, applied the wrong income or capital figure, missed a disregard you're entitled to, charged the wrong non-dependant deduction, or refused a discretionary reduction without proper consideration.

You can also appeal if the council took too long to process your claim. If Bolton Council doesn't issue a decision within a reasonable time, you have the right to escalate — you don't have to wait indefinitely.

Step 1: Request an Internal Review

Before going to the Valuation Tribunal, you must ask Bolton Council to review its own decision. This is the mandatory first step.

Write to the Revenues and Benefits Service within one calendar month of receiving the decision notice. Your letter or email needs to set out:

  • Which specific part of the decision you're disputing
  • Why you believe it's wrong (an incorrect income figure, a missed disregard, a non-dependant deduction that shouldn't apply)
  • Any supporting evidence — payslips, benefit letters, bank statements, medical evidence

A senior officer who wasn't involved in the original decision will reassess the case. The council should respond in writing within two calendar months.

Step 2: Escalate to the Valuation Tribunal for England

If Bolton Council upholds its decision on review, or doesn't respond within two months, you can appeal directly to the Valuation Tribunal for England (VTE).

The VTE is completely independent of Bolton Council. It's a statutory judicial body established under Section 16 of the Local Government Finance Act 1992. Key facts:

  • Deadline: You must lodge your appeal within two calendar months of receiving the council's written review decision, or within two months after the council's response deadline expired (if they didn't respond at all)
  • Cost: Entirely free. You pay nothing to submit an appeal or attend a hearing
  • Format: You can present your case through written representations alone, or request an oral hearing (in person or remote)

The tribunal panel examines whether Bolton Council applied its adopted scheme rules correctly. They can overturn the decision and direct the council to recalculate your award.

What the Tribunal Can and Can't Do

The VTE can rule on whether the council applied its own scheme correctly — did it use the right income figures, apply the correct taper rate, account for the right disregards? It can order the council to reassess your claim.

The VTE cannot change Bolton's scheme rules themselves. If you disagree with the 17.5% minimum payment or the £3,000 capital limit as a policy, the tribunal isn't the route — those are decisions made by Bolton's full council each year.

Band Challenges Are a Different Process

If your dispute is about which council tax band your property is in (you think your home should be Band A rather than Band B, for example), that's not a CTR appeal. Property valuations are handled by the Valuation Office Agency, not Bolton Council or the VTE's CTR jurisdiction. Contact the VOA directly: 03000 501501.

Keep a Paper Trail

From the moment you receive a decision you disagree with, keep dated copies of everything — the original decision notice, your review request, any response, and all supporting documents. If the case reaches the VTE, this trail is your evidence.

The Bolton Council Tax Reduction guide includes an appeal and review log worksheet with dated fields for each stage, plus a template structure for your internal review letter, so you can track deadlines and build your case systematically.
