How to Appeal a Council Tax Reduction Decision in Bromley
When You Can Challenge a Decision
If you disagree with how Bromley calculated your Council Tax Support — whether it's an eligibility refusal, an award amount that seems wrong, a backdating rejection, or an overpayment demand — you have a statutory right to challenge it. The process has two stages: an internal review by the council, then an independent tribunal if needed.
You can challenge any CTS decision, but the tribunal cannot overturn the scheme's underlying policy. The 50% working-age cap and the Band D ceiling are adopted rules — you can argue they were applied incorrectly to your circumstances, but you can't argue they shouldn't exist.
Stage 1: Internal Review (Section 16, LGFA 1992)
Start by requesting a formal internal review. Submit a written challenge to the Revenues and Benefits Department, clearly stating it's a "Statutory Appeal under Section 16 LGFA 1992."
Your submission needs:
- Your full name and council tax account reference
- The date of the decision notice you're challenging
- Detailed grounds explaining why the decision or calculation is wrong
- Supporting evidence (payslips, benefit letters, bank statements — anything that shows the council got the numbers wrong)
Send it to [email protected] or by post to Churchill Court, 2 Westmoreland Road, Bromley, BR1 1AS.
Timeline: Submit as soon as possible — ideally within one calendar month of the decision notice. The council then has two calendar months from receipt to issue a formal written response. A senior officer who wasn't involved in the original calculation reviews your case.
Stage 2: Valuation Tribunal for England (VTE)
If the council upholds its original decision after the internal review, or if the council fails to respond within two months, you can appeal to the Valuation Tribunal for England. The VTE is an independent statutory body — it's completely separate from Bromley Council.
Key facts about VTE appeals:
- Filing is completely free
- You can appeal online at valuationtribunal.gov.uk
- The deadline is two calendar months from the council's internal review decision
- If the council never responded to your internal review, the deadline is four calendar months from when you submitted the review request
- The tribunal can order the council to recalculate your award, grant backdating, or cancel an overpayment demand

Keep Paying While You Appeal
Filing an internal review or VTE appeal does not suspend your obligation to pay council tax. You must continue paying your monthly instalments throughout the process. If you stop paying because you're disputing the amount, the council can still issue recovery proceedings — including a summons and liability order.
If your appeal is successful and you've overpaid, the excess is credited to your council tax account. You can then request a direct refund to your bank account via the Council Tax Refund Form on the Bromley website.
Common Grounds for Challenge
The strongest challenges are based on factual errors in the calculation:
- Income counted incorrectly — a disregarded benefit (PIP, DLA, war pension) was included in your means test
- Non-dependant deductions applied wrongly — the council deducted for someone who doesn't live with you, or used the wrong income tier
- Capital miscalculated — savings were double-counted, or a property you don't own was attributed to you
- Effective date wrong — your claim should have started earlier based on the UC-linked rule or an advance claim
- Good cause for backdating wasn't properly considered — you provided evidence of illness or bereavement that was dismissed without adequate reasoning
Challenges based on general disagreement with the 50% cap or Band D limit won't succeed at tribunal. Those are policy decisions made by Bromley Full Council, not administrative errors.
