Backdate Council Tax Reduction in County Durham: The 12-Month Rule
Working-Age Backdating: Up to 12 Months
If you qualified for Council Tax Reduction in County Durham but didn't apply at the time, you can request that the council backdate your award by up to 12 months. But unlike pension-age residents — who can receive up to three months' backdating without showing good cause, provided they were eligible throughout that period — working-age claimants must prove "good cause" for every month they're claiming retrospectively.
The 12-month clock runs from the date the council receives your backdating request, not from when you first became eligible.
What "Good Cause" Actually Means
Good cause means you had a genuine reason, continuously throughout the entire backdating period, for not applying sooner. Durham County Council looks for circumstances that prevented you from making a claim — not just that you didn't know about the scheme.
Examples identified in the scheme guidance include:
- Serious illness or hospitalisation that stopped you from managing paperwork
- Bereavement of a close family member during the period
- Misleading official advice — a council officer or DWP adviser told you that you didn't need to apply separately
The critical word is "continuously." If the council decides your good cause applied for the first six months but not the last three, they'll only backdate six months. You need to show a connected thread of reasons covering the entire period you're claiming.
How to Structure a Backdating Request
Your request needs to be specific and chronological. A vague statement like "I didn't know about it" is unlikely to succeed. Instead, lay out a timeline:
- State the backdating period — "I request backdating from [date] to [date], a period of [X] months"
- Explain the circumstances month by month — what was happening in your life that prevented you from applying
- Provide supporting evidence — GP letters, hospital discharge summaries, DWP correspondence, bereavement certificates, or statements from support workers
- Show when the barrier ended — explain what changed that enabled you to apply now
The council decides backdating requests on a case-by-case basis. There's no automatic entitlement, but a well-documented request with clear evidence significantly improves your chances.

What Happens If the Council Says No
If Durham County Council refuses your backdating request, you have the right to challenge the decision. The process follows the standard CTR dispute route:
- Written reconsideration — submit a formal written request to the council explaining why you disagree, with any additional evidence
- Council response — the council has two months to reconsider
- Valuation Tribunal for England — if the council upholds the refusal (or doesn't respond within two months), you can appeal to the VTE within two months of their response (or four months if they don't respond at all)
The VTE appeal is free and independent of the council.
The Financial Impact
Backdating can be worth hundreds of pounds. If you would have qualified for a 90% discount on a Band A property (roughly £1,300 per year), each month of backdating is worth about £97. A full 12-month backdate at 90% could credit approximately £1,170 to your Council Tax account.
The council applies the backdated discount directly to your account, reducing any outstanding balance or generating a credit against future instalments.
