How to Backdate Council Tax Reduction in North Yorkshire

The 12-Month Backdating Rule

Working-age residents in North Yorkshire can request backdated Council Tax Reduction for up to 12 months before the date they formally apply. If you were eligible but delayed applying, a successful request can recover a substantial amount. The 2026/27 Band D amount for North Yorkshire Council services alone is £2,036.32, so a 100% reduction on a Band D account can credit over £2,000 against the bill.

Pension-age applicants get automatic backdating of up to three months without needing to give a reason. Working-age applicants need to demonstrate "good cause" for the delay.

What Counts as Good Cause

The council assesses whether you had a continuous, reasonable explanation for not applying sooner. Common grounds include:

  • Illness or hospitalisation that prevented you from managing your affairs
  • Bereavement — dealing with a death in the family
  • Being given wrong information by an official body, advice agency, or DWP

The key word is "continuous." If your good cause ended six months ago but you still didn't apply for another five months, the council may only backdate to the point where the barrier lifted. You need to explain why the delay lasted the full period you're claiming for.

How to Request Backdating

Backdating isn't automatic — you need to explicitly ask for it, either within your CTR application or as a separate written request. State clearly:

  1. The period you want covered (e.g., "I request backdating from 1 November 2025 to the present")
  2. Your reason for not applying sooner — be specific, with dates
  3. Any supporting evidence — hospital discharge letters, DWP correspondence showing misdirection, a GP note

If the council grants the backdating, the awarded reduction is credited to your Council Tax account. If this creates an overpayment (you've been paying in full while you were actually entitled to a discount), you'll receive an adjusted demand notice with lower remaining instalments or a credit balance.

If Backdating Is Refused

The council must respond to your request in writing. If they refuse, you can submit a formal written grievance stating why you believe the decision was wrong. The council then has two months to reconsider.

If they reject the grievance or don't respond within two months, you have the right to appeal to the Valuation Tribunal for England (VTE). VTE appeals are free — no tribunal fees, though you'd cover your own costs if you chose to hire a solicitor. The appeal must be lodged within four months of the date you sent your original grievance to the council.

Don't Wait Longer Than You Need To

Every month you delay applying is a month of potential backdating you lose. Even if you think your circumstances are complicated, submit the application now and request the maximum backdating period. The council may grant a shorter period or refuse the request, so apply as soon as you can.
