Backdating Council Tax Reduction in Somerset: The 3-Month Rule and Good Cause

Before April 2025, Somerset Council allowed working-age residents to backdate their Council Tax Reduction claims by up to 12 months. That window has been cut to just 3 months — and you need to demonstrate continuous "good cause" for the entire period you're requesting.

What Changed and Why

The 3-month backdating limit was part of the structural reforms Somerset Council introduced on 1 April 2025, driven by the financial emergency the council declared in November 2023. Alongside cutting discount bands (Band 2 dropped from 75% to 50%, Band 3 from 40% to 25%, Band 4 from 25% to 10%) and introducing the Band D property cap, the backdating restriction was designed to reduce costs.

For 2026/27, the 3-month limit remains in place. If you should have claimed CTR three months ago but didn't, you can potentially recover that support. Four months ago? That money is gone.

What Counts as Good Cause

Somerset Council evaluates backdating requests against a "continuous good cause" test. You can't just say you didn't know — you need to show a genuine reason that prevented you from applying throughout the entire backdating period. Examples of reasons you can explain include:

  • Serious illness or hospitalisation — physical or mental health conditions that made it impossible to manage your affairs
  • Bereavement — particularly the death of a partner who handled household finances
  • Documented official misinformation — if a council officer, DWP adviser, or similar authority figure told you that you weren't eligible or didn't need to apply separately
  • Systemic access barriers or unaddressed communication needs that prevented you from applying
  • Unmanaged bereavement that affected your ability to apply

The critical word is "continuous." If your good cause applies for the first month but not the second, the council can limit your backdating to just that first month.

How to Request Backdating

You can request backdating in two ways:

  1. During your initial application — the online claim form includes a section for backdating requests. Tick the box and provide your written explanation.
  2. After your claim is processed — submit a written backdating request through the council's online portal or by letter. The maximum period is the 3 calendar months immediately before Somerset Council receives the written request, so make the request as soon as you can.

Your written statement should be specific. Don't write "I was ill." Write "I was admitted to Musgrove Park Hospital from 14 August to 3 September 2026 for surgery, followed by six weeks of home recovery during which I could not manage administrative tasks." Attach evidence where possible — hospital discharge letters, GP notes, or correspondence showing incorrect official advice.

Pensioners Have Different Rules

If you've reached State Pension age, the national prescribed rules give you automatic backdating of up to 3 months without needing to prove good cause — you need to have met the eligibility criteria during that period. Somerset Council cannot restrict this statutory rule.

What If You're Refused

If Somerset Council rejects your backdating request, you can challenge the decision through the same two-tier appeal process that applies to all CTR decisions: a formal written grievance to the council under Section 16 of the Local Government Finance Act 1992, followed by an appeal to the Valuation Tribunal for England if the council doesn't resolve it.
