Retirement Village and Strata Pensioner Rates Rebate in NSW

Living in a retirement village, a land lease community, a strata unit, or a granny flat doesn't automatically exclude you from the pensioner rates rebate — but the type of title you hold makes all the difference. Some arrangements qualify fully; others don't qualify at all.

Strata Title: You Qualify

If you own a strata unit and hold a qualifying concession card, you're fully eligible for the Section 575 pensioner rates rebate. Strata unit owners hold individual title deeds and receive their own council rate assessment. The rebate works exactly the same as for a freestanding house — up to $250/year on rates and waste, applied to your individual assessment.

If you're a pensioner in a strata building and haven't applied, you're leaving money on the table. The strata levies you pay to the body corporate are separate from (and unrelated to) the council rates rebate.

Retirement Villages: Usually Not Eligible

Most retirement village residents can't claim the council rates rebate directly. The reason is structural: in a typical retirement village operating under a loan/licence or leasehold arrangement, the village management company receives a single consolidated council rate notice for the entire complex. Individual residents don't have separate rate assessments, so there's nothing for the concession to attach to.

The exception is retirement villages where residents hold individual freehold or strata title. In those developments, each unit has its own council rate assessment, and the pensioner rebate can be claimed normally.

Even if you can't claim the council rates rebate, you may still be able to claim:

  • Sydney Water or Hunter Water pensioner rebate — if you receive an individualised water bill (sub-metered) rather than having water bundled into your village fees
  • NSW Private Water Pensioner Rebate — $105 to $679/year if your village is supplied by a licensed private water utility
  • Energy concessions through your electricity and gas retailer

Check your billing arrangements with the village manager to see which utility accounts are in your name.

Land Lease Communities

Residents in residential land lease communities (formerly known as residential parks) hold their manufactured home but rent the site from the community operator. Council rates are levied on the operator, not individual homeowners. The same barrier applies: without an individual rate assessment, you can't claim the Section 575 rebate.

Site fees are separate from the council rates rebate. Contact the community operator about site-fee questions.

Life Tenancy: You Qualify

If you've been granted a life interest or life tenancy under a Will — meaning you have the right to live in the property for your lifetime — you can claim the pensioner rates rebate even though you're not the registered owner on the title.

You'll need to provide the council with documentation establishing your life tenancy: a copy of the Will, Probate documents, or a solicitor's declaration confirming your life interest and your liability for rates. Once verified, you receive the full rebate.

Granny Flat Interest

A "granny flat interest" is a formal legal arrangement — typically created under a family agreement — giving you the right to live in a property (or part of it) for your lifetime. This is common where a parent contributes financially to a child's property in exchange for the right to live there.

The council's documented criteria recognize registered owners, part-owners, and verified life tenants. Ask the council's revenue department whether your granny flat documents establish an interest it can accept.

If the council won't recognise your interest, ask about Section 577 hardship provisions — the council may be able to deem you an eligible ratepayer if strict application of the ownership rules causes financial hardship.

The NSW Pensioner Rates Rebate Claim Guide covers every property type — strata, freehold, retirement village, land lease, life tenancy, and granny flat — with the specific documentation and application steps for each.
