Life Tenancy and Granny Flat Interest — Pensioner Rates Rebate in NSW
Life Tenants Are Eligible — With the Right Proof
A life tenant is someone who has been granted the right to live in a property for their lifetime, usually through a Will or a formal deed. Even though a life tenant does not own the property outright, they are liable for rates during the tenancy and can claim the pensioner rates rebate under Section 575 of the Local Government Act 1993.
The critical requirement is documentation. Your council needs evidence of the life tenancy arrangement — a certified copy of the Will granting the life interest, the Probate grant, or a solicitor's letter confirming the terms. Without one of these, the council has no way to verify that you are legally liable for rates.
Section 577 of the Act goes further. It allows councils to extend pensioner concessions to persons who would otherwise be disqualified — including by deeming a life tenant "solely liable" for rates — to prevent severe financial hardship. If you hold a life interest and have been rejected under the standard Section 575 rules, ask your council about a Section 577 hardship extension.
Granny Flat Interests: The Grey Area
A "granny flat interest" typically refers to an arrangement where a pensioner provides capital (often the proceeds from selling their previous home) in exchange for the right to live in a property owned by a family member — usually an adult child. The interest is registered as a charge against the title or documented in a formal agreement.
Under standard Section 575 rules, the applicant must be a registered owner, part-owner, or verified life tenant. A granny flat interest is not itself listed as a standard ownership category, and the holder's name may not appear on the council's rating assessment.
Ask the council whether your specific agreement meets its ownership or life-tenancy criteria. Under Section 577, a council may extend eligibility in cases of severe financial hardship, but an extension is not automatic.
If your arrangement is a granny flat interest:
- Contact your council's revenue department and explain the arrangement
- Provide the registered granny flat interest agreement or the deed creating the right
- Ask whether the council can apply a Section 577 hardship extension if the standard eligibility rules exclude you
Strata Title: Standard Eligibility Applies
Strata unit owners hold individual title and receive their own council rates assessment. If you own a strata unit, hold a Pensioner Concession Card, and live in the unit as your principal residence, you qualify for the full Section 575 rebate exactly as a freestanding house owner would.
The concession applies to the ordinary rates and domestic waste charges on your individual strata lot. Body corporate fees and special levies imposed by the owners corporation are not council charges and are not covered.

Retirement Villages and Land Lease Communities
Retirement village residents who hold a loan, licence, or leasehold arrangement — rather than a freehold or strata title — generally do not receive individual council rates notices. The village operator pays rates on the entire site. In this case, the individual resident cannot claim a Section 575 rebate because they are not the ratepayer on the council's books.
Some retirement villages pass rates through to residents as part of the recurrent charges. Even so, the council concession goes to the legal ratepayer (the operator), not to individual residents. This is a common point of confusion, and the existing post on retirement village pensioner rates covers it in detail.
