Owner-Occupier and Principal Place of Residence Rules for QLD Rates Concessions

Three Requirements That Must All Be Met

To qualify for Queensland's state Pensioner Rate Subsidy, you must satisfy three requirements. Council-funded remissions have their own local criteria:

  1. You own the property or hold a qualifying life tenancy. An owner's name must be registered on the title deed and council rating assessment. A life tenancy qualifies only when created by a valid will after the owner's death or by a Supreme or Family Court order.

  2. It is your principal place of residence. You must physically live in the property as your primary home. A holiday house, an investment property, or a property you own but rent to tenants does not qualify.

  3. You are liable for the rates. You must be the person legally responsible for paying the council rates levied on that assessment. This requirement intersects with the title requirement — in most cases, the registered owner is the liable party.

What "Principal Place of Residence" Actually Means

Councils assess principal place of residence on the facts. It is the one property where you live day-to-day, receive your mail, are enrolled to vote, and where your daily living arrangements are centred. You can own multiple properties, but only one qualifies as your principal place of residence for rate concession purposes.

If you own two homes — say a house in Brisbane and a weekender on the Sunshine Coast — only the one you actually live in most of the time qualifies. There is no formula based on counting nights; councils look at the overall pattern of occupancy.

Temporary Absences

A temporary absence does not automatically forfeit your principal place of residence status. If you are away because of a hospital stay, respite care, rehabilitation, or temporary health-related absence, the property is still treated as your principal place of residence — provided you intend to return and the property is not rented out while you are away.

The critical qualifier is that the dwelling must not be leased to a tenant during the absence. If any portion of the property is rented under a paid tenancy, councils disallow or apportion the concession under their local policy.

Some councils apply a time limit to temporary absences, particularly for aged care admissions. If a pensioner enters permanent residential aged care and the property is no longer occupied as their home, the concession eligibility lapses. The specifics vary by council — contact your council's rates team if you are navigating this transition.

Renting Out Part of the Property

If any portion of the residential property is rented out under a paid tenancy agreement — a granny flat, a secondary dwelling, a room through a lodging arrangement — councils disallow or apportion the concession under their local policy. A full concession is not automatic when the property generates rental income.

The council's policy determines whether a rental arrangement disqualifies the property or results in an apportioned concession. Disclose any rental arrangement in your application. If a council finds that a concession was applied in error, it can issue an adjusted rate notice and debit the unearned concession to your rates account as an outstanding liability.

Joint Ownership and Title Structures

The owner-occupier requirement interacts with title structures in specific ways:

  • Married or de facto couples who jointly own the property receive the full concession even if only one partner holds a qualifying PCC or DVA Gold Card. The couple is treated as a single household.

  • Unrelated joint tenants or tenants in common — such as an adult child and an aged parent who co-own a home — receive a pro-rated concession based on the eligible pensioner's ownership share. A pensioner holding 50% of the title as tenant in common receives 50% of the maximum concession.

  • Life tenancies qualify when established by a valid probated will or court order, with the life tenant required to provide documentary proof. Life tenancies created by informal family agreements are not eligible.

  • Trust and company ownership is ineligible for the state subsidy and standard council remissions — even if the beneficial owner is a pensioner who lives there full-time. The exception is Special Disability Trust property in councils that specifically allow it.

How Councils Verify

Councils use Centrelink Confirmation eServices (CCeS) to verify card status before rating runs, and compare the applicant's details with the property title and council rating assessment. An application may also require supporting documents such as a card copy or proof of ownership.

You are required to notify your council within 21 to 30 days of any change in circumstances that affects your eligibility. This includes selling the property, moving to a different address, entering residential aged care, renting out the property or part of it, or changes to the ownership structure on the title deed. Telling Centrelink about a change does not automatically update your council records — you must notify each authority separately.

What Happens If You Get It Wrong

If a council determines that a rate concession was applied in error — the property was not actually the principal place of residence, or a rental arrangement was not disclosed — the council issues an adjusted supplementary rate notice. The concession amount is debited back to the rates assessment and becomes an outstanding rate liability, potentially with penalty interest.
