Special Disability Trust Rates Concession QLD

The General Rule: Trusts and Companies Are Excluded

Queensland's Pensioner Rate Subsidy Scheme has a strict ownership requirement. The applicant's name must appear on the property title held by Titles Queensland, and they must be personally liable for the council rates. When land is held in the name of a private company, a family trust, or any corporate entity, it is ineligible for the state rate subsidy and standard council pensioner remissions — even if the person living there full-time holds a valid Pensioner Concession Card.

This catches families off guard. A parent might have transferred the house into a family trust years ago for asset protection or estate planning, only to discover at retirement that the trust structure locks them out of council rate concessions worth hundreds of dollars a year.

Special Disability Trusts Are the Exception

A Special Disability Trust (SDT) is a specific trust type recognised under the Social Security Act 1991 and the Veterans' Entitlements Act 1986, set up to provide for the beneficiary's current and future care and accommodation needs. Its social-security treatment depends on meeting the statutory requirements; it is not blanket protection for every asset or payment.

Certain Queensland councils treat SDT-held property differently from ordinary trust-held property. Brisbane City Council, for example, permits pensioner rate remissions on residential property held within a Special Disability Trust, provided two conditions are met: the principal beneficiary holds a qualifying concession card (PCC or DVA Gold Card), and the beneficiary resides permanently in the property as their principal place of residence.

The state subsidy requires the applicant to be the owner or life tenant of the principal place of residence and legally responsible for its rates. Brisbane's SDT provision is a separate council rebate, which can reach up to $1,350 per year for a full-pension recipient.

What You Need to Apply

If your council does recognise SDT properties for rate concessions, the documentation requirements are heavier than a standard pensioner application:

  • A copy of the trust deed showing the trust's beneficiary
  • The principal beneficiary's PCC or DVA Gold Card and proof of pension or concession eligibility
  • A copy of the rates notice, if available
  • Permanent residence — the beneficiary must live in the property as their principal residence; ask the council what proof it requires

In Brisbane, an SDT beneficiary must apply at a Council Customer Centre or ward office. Confirm the application route and supporting documents with your own council.

Not Every Council Offers This

SDT rate concessions are council-funded discretionary remissions, not a state-mandated entitlement. Each council decides independently whether to include SDT properties in its annual Revenue Statement. Brisbane City Council is the most prominent council that explicitly allows it, but policies vary across Queensland's 77 local government areas.

Before assuming your council participates, check its current Revenue Statement and Pensioner Rates Concession Policy. If SDT properties are not mentioned, ask the council in writing whether an SDT-specific rebate or another local concession can cover the property and what application route applies.

What If Your Council Says No

If the council does not offer rate concessions for SDT-held property, the beneficiary has limited options through the rates system. But they should still check eligibility for other Queensland Government concessions, including the Emergency Management Levy discount, the SEQ Pensioner Water Subsidy (up to $120 per year in South East Queensland), and state energy rebates through their electricity retailer. These are separate programs with their own eligibility rules; the water subsidy is administered by the water retailer for eligible account holders.

For families considering establishing an SDT that will hold residential property, it is worth checking the relevant council's position on SDT rate concessions before the trust is settled. The difference between a council that allows remissions and one that does not can amount to over a thousand dollars a year.

Our Queensland Pensioner Rate Subsidy guide walks through every concession layer — state subsidy, council remissions, water subsidies, and the documentation requirements for complex ownership structures like Special Disability Trusts.
