Leicester Council Tax Arrears: Payment Plans, Court Summons, and Getting Help

How Council Tax Arrears Escalate in Leicester

Falling behind on council tax triggers a fixed enforcement sequence. Understanding where you are in that sequence determines what options you have.

Stage 1 — Missed payment: If you miss an instalment, Leicester City Council sends a reminder giving you seven days to pay the overdue amount. Pay within seven days and your instalments continue normally.

Stage 2 — Further missed payments: If you miss another instalment, the council sends a second reminder. If you fall behind again, it sends a final notice and you lose the right to pay by instalments. The full remaining annual balance becomes due.

Stage 3 — Court summons: If the full balance remains unpaid, the council applies to the Magistrates' Court for a liability order. The court summons adds costs — typically around £70 — to your debt. You do not need to attend the hearing, but if you dispute that you owe the amount, attendance gives you a chance to explain.

Stage 4 — Liability order: Once the court grants a liability order, the council has broad enforcement powers: attachment of earnings (deductions from your wages), deductions from benefits (including Universal Credit), referral to bailiffs (enforcement agents), charging orders on property, or in extreme cases, committal proceedings.

Payment Plans Before and After a Liability Order

Before a liability order: You can contact the council and negotiate a payment arrangement. Leicester City Council's revenues team (0116 454 1005) can spread your arrears over an agreed period. This is informal — the council is not legally required to agree, but most do because it is cheaper than court proceedings for both sides.

After a liability order: Payment arrangements are still possible, but the council holds the enforcement power. You can still call and propose a realistic payment schedule. Be prepared to explain your income and expenses. The council may ask for a financial statement.

The earlier you contact the council, the more flexibility you have. Once a liability order exists, the council can instruct bailiffs at any time — even while you are making agreed payments, if you miss one.

Council Tax Overpayment Recovery

If your Council Tax Reduction is recalculated downward — because of a delayed change report or a backdated reassessment — the council does not ask for cash back. Instead, the excess support is removed from your council tax account. Your liability increases for the relevant period, and a revised demand notice is issued spreading the balance across your remaining instalments.

This is not a penalty. It is a corrected bill. But it can feel like one when your monthly payments jump without warning.

Bailiff Rules

If Leicester City Council refers your debt to enforcement agents (bailiffs), they must follow the Taking Control of Goods Regulations 2013. Bailiffs must give you at least seven days' written notice before their first visit. They cannot force entry on a first visit to a residential property — they can only enter through an open door or one you open voluntarily.

Bailiffs can:

  • List goods in your home to be seized if payment is not made
  • Return and, on subsequent visits, force entry if you previously let them in and they signed a controlled goods agreement
  • Add fees to your debt at each stage of enforcement

Bailiffs cannot:

  • Enter your home by force on the first visit
  • Take essential household items (cookers, beds, washing machines, clothing, tools of your trade up to £1,350)
  • Take goods belonging to someone else in the household
  • Use threatening or aggressive behaviour

If a bailiff visits and you cannot pay, do not let them in. Seek advice immediately from StepChange (stepchange.org) or National Debtline (nationaldebtline.org) — both are free.

Where to Get Free Debt Advice

Council tax debt is a "priority debt" — it carries harsher enforcement consequences than credit cards or personal loans. If you are in arrears, get specialist debt advice before trying to negotiate on your own.

Citizens Advice LeicesterShire: 0808 278 7970 (freephone, Monday–Friday 9am–4.30pm). In person at York House, 91 Granby Street, Leicester LE1 6FB.

StepChange Debt Charity: stepchange.org — free online debt advice and payment plan negotiation.

National Debtline: nationaldebtline.org — free telephone and online advice.

These organisations can negotiate with the council on your behalf, help you complete financial statements, and in some cases represent you if enforcement has gone too far.
