Kirklees Council Tax Reduction: War Pension and LCWRA Rules
War pension recipients and Universal Credit claimants with the LCWRA health element have a complicated relationship with Kirklees's Council Tax Reduction scheme. Both groups used to enjoy protected status — meaning they could get up to 100% reduction. That protection was abolished in April 2024, but some important financial advantages remain.
War Pensions: The Full Income Disregard
War Disablement Pensions and War Widow's/Widower's Pensions are fully disregarded as income in the Kirklees CTR means test. This is a national rule, not a local choice — the council cannot count these payments when calculating your income.
In practical terms, if your only income is a War Disablement Pension, the means test treats your income as zero. You'd receive the maximum CTR award: 75% of your net Council Tax liability (after any discounts like the Single Person Discount). You still pay the mandatory 25% minimum — the income disregard helps with the means test, but it doesn't override the minimum contribution rule.
This disregard also means a War Pension won't generate a surplus income deduction. If you have other income sources (state pension, private pension, earnings), the war pension portion is stripped out before the 20% taper calculation begins.
LCWRA: What the Health Element Does
If you receive Universal Credit with the Limited Capability for Work and Work-Related Activity (LCWRA) element, you're recognised as having a significant health condition or disability that limits your ability to work.
Before April 2024, LCWRA recipients in Kirklees were a protected group — eligible for up to 100% CTR with no mandatory minimum. Under the reformed scheme, LCWRA claimants pay the same 25% minimum as everyone else of working age.
However, the LCWRA element affects your applicable amount in the means test. Your applicable amount is the government's calculation of what you need to live on — and having LCWRA increases that threshold. A higher applicable amount means less surplus income, which means a higher CTR award.
LCWRA recipients who also receive PIP Daily Living component get an additional advantage: non-dependant deductions are waived entirely. If adult children or other family members live with you, their income won't reduce your CTR.
Housing Benefit and Council Tax Reduction: Separate Claims
Kirklees still processes Housing Benefit for some claimants who haven't yet moved to Universal Credit. If you're one of them, here's the key point: Housing Benefit and Council Tax Reduction are applied for through the same form, but they're two separate entitlements.
Housing Benefit covers rent. CTR covers Council Tax. Receiving one doesn't automatically give you the other, though applying through the combined form means both are assessed at once.
If you're on Universal Credit, housing costs are included in your UC award (as the housing element), so you wouldn't claim Housing Benefit separately. But Council Tax Reduction is never part of Universal Credit — you always need to apply to Kirklees directly, regardless of which benefit system you're on.
