How to Appeal a Council Tax Reduction Decision in Leicester
Two Stages, Strict Deadlines
If Leicester City Council gets your Council Tax Reduction calculation wrong — the income band is incorrect, they counted income that should have been disregarded, or they applied a non-dependant deduction that does not apply — you have a statutory right to challenge it. The appeal process has two stages with firm time limits.
Do not confuse this with a council tax band challenge. Band disputes (where you think your property is valued in the wrong band) go to the Valuation Office Agency. Council Tax Reduction disputes — about how much support you receive — follow the route below.
Stage 1: Written Grievance to Leicester City Council
Before you can appeal to an independent body, you must first raise a formal written grievance directly with Leicester City Council. This is not optional — the Valuation Tribunal will not hear your case until you have completed this step.
Your written grievance must:
- Identify the specific decision you are challenging (reference the decision notice date and your council tax account number)
- Explain why you believe the calculation is wrong, with specific grounds (incorrect income figure, missing disregard, wrong household classification)
- Include any supporting evidence — payslips, UC statements, benefit award letters, or other documents that back your case
Submit it by email to [email protected] or through the council portal. Keep a copy and note the date.
The council has two calendar months from receipt to review your case and issue a written decision. During this period, they may ask for additional information. Your council tax bill remains payable while the grievance is being considered — the dispute does not pause your liability.
Stage 2: Appeal to the Valuation Tribunal for England
If the council rejects your grievance — or if two months pass without any written response — you can escalate to the Valuation Tribunal for England (VTE). The VTE is an independent judicial body with no connection to Leicester City Council.
The deadline to lodge your VTE appeal is two months from whichever comes first:
- The date of the council's Stage 1 decision notice
- The date the council's two-month response window expired without a decision
Appeals to the VTE are free. You do not need a solicitor, though you can bring a representative or adviser. Citizens Advice LeicesterShire can help prepare your case and may attend as a representative — call 0808 278 7970 to ask about their tribunal support.

What Grounds Work
The VTE looks at whether the council applied its own scheme rules correctly. Strong grounds include:
- The council placed you in the wrong income band (your net weekly income falls in a different range than they calculated)
- A specific income disregard was not applied (Child Benefit was counted, housing costs were counted, or War Pension income was included)
- The council incorrectly classified your household as non-vulnerable when you have qualifying disability or carer evidence
- A non-dependant deduction was applied to an exempt person (a full-time student or someone receiving qualifying disability benefits)
- Backdating was refused despite evidence of continuous good cause
Weak grounds include disagreeing with the scheme rules themselves (the VTE enforces the adopted scheme, it cannot change it) or arguing that the minimum payment is unfair.
What Happens at the Tribunal
VTE hearings are relatively informal compared to a court. You can attend in person or request a paper-based decision where the tribunal reviews written submissions without a hearing. The tribunal panel reads the evidence, hears from both you and the council, and issues a binding decision.
If the VTE agrees with you, it can order the council to recalculate your award. The council must then revise your bill accordingly and refund any overpayment.
Timing Matters
The two-month deadlines at each stage are strict. If circumstances beyond your control prevented you from appealing on time, the VTE may accept a late appeal, but do not rely on an extension. Set a reminder when you submit your Stage 1 grievance, and do not rely on the council contacting you — chase them if you have not heard back within six weeks.
The Leicester Council Tax Reduction guide includes an appeal preparation worksheet with a structured template for both the Stage 1 grievance letter and the VTE submission, designed to present the grounds the tribunal looks for.
