How to Appeal a Council Tax Reduction Decision in Dudley

Two Stages, Two Deadlines

If Dudley Council gets your Council Tax Reduction calculation wrong — or you believe they have — there's a statutory two-stage dispute process. Stage 1 goes back to the council. Stage 2 goes to an independent tribunal. Each stage has a deadline; the tribunal may allow a late appeal in some circumstances.

You can challenge the award amount, the income assessment, the start date, a backdating refusal, an overpayment decision, or a Section 13A hardship refusal. The process is the same for all of them.

Stage 1: Internal Review by Dudley Council

You have one calendar month from the date on your CTR decision notice or revised bill to submit a formal written request for reconsideration.

Key points:

  • The request must be in writing — a phone call to Dudley Council Plus does not protect your deadline
  • Submit through the DMBC appeals portal online or email [email protected]
  • Dudley has a "Benefit Appeals Form" you can use, but any clear written request that identifies the decision and explains why you disagree will work
  • State specifically what you think is wrong: the income figure used, a missing disability premium, an incorrect non-dependant deduction, a start date error

Dudley must review the calculation, correct any errors, and issue a written response. If they agree with you, they'll issue a revised decision notice and adjust your bill. If they maintain the original decision, their response must explain why.

Stage 2: Valuation Tribunal for England

If Dudley maintains its decision after Stage 1, or fails to respond to your grievance within two calendar months, you can appeal directly to the Valuation Tribunal for England (VTE).

If Dudley responds, lodge your VTE appeal within two calendar months of its written refusal. If it does not reply within two months, the VTE says to appeal within four months from the date you first contacted the council.

The VTE is completely independent of Dudley Council. Appeals are free. You submit through the tribunal's digital portal at valuationtribunal.gov.uk.

What the Tribunal Can and Can't Do

The VTE has jurisdiction over:

  • CTR award calculations and eligibility
  • Income assessment accuracy
  • Start date disputes
  • Backdating refusals
  • Section 13A discretionary relief refusals

The VTE cannot handle complaints about administrative delays, lost documents, rude staff, or general maladministration. Those go through Dudley's internal "Putting Things Right" complaints process, with escalation to the Local Government and Social Care Ombudsman if needed.

A Worked Timeline

Suppose Dudley issues your CTR decision notice on 12 October 2026.

Deadline for Stage 1: You must submit a written grievance by 12 November 2026 (one calendar month).

Scenario A — Dudley responds on 28 November: They maintain the original decision. Your VTE appeal deadline is 28 January 2027 (two months from refusal).

Scenario B — Dudley doesn't respond: The response period expires on 12 January 2027, so you can appeal then. The VTE filing deadline is 12 March 2027 (four months from the date you first contacted Dudley).

Preparing a Strong Challenge

The most common successful challenges involve factual errors the council made in processing your claim:

  • Wrong income figure — they used gross instead of net, or counted a disregarded benefit (PIP, DLA, Child Benefit) as income
  • Missing premium — a disability or carer premium wasn't applied to your applicable amount
  • Incorrect non-dependant deduction — they applied the £5 weekly deduction when you have PIP Daily Living (which should waive it)
  • Start date error — your CTR should have aligned with your UC claim date but didn't

For each challenge, reference the specific number on your decision notice and explain what the correct figure should be, with supporting evidence. A letter that says "my award seems too low" gives the council nothing to work with. A letter that says "my decision notice shows weekly income of £180, but my attached payslips show net weekly income of £145" gets results.

Keep Paying While You Appeal

Appealing doesn't suspend your obligation to pay council tax. Continue paying at the current instalment rate. If your appeal succeeds and you've overpaid, Dudley credits the difference to your account and you can request a refund.

If you stop paying during the appeal, the council can initiate enforcement proceedings regardless of the open dispute.

The Dudley Council Tax Reduction guide includes a Decision Audit Worksheet to help you identify calculation errors before submitting your appeal.
