Dudley Council Tax Arrears — Free Debt Help and What to Expect

Council tax arrears in Dudley follow a strict legal recovery process. Understanding what happens at each stage — and getting free advice before enforcement escalates — gives you far more options than waiting for the next letter.

This is not legal or debt advice. If you are already facing a court summons, liability order, or enforcement agent visit, contact a free debt adviser immediately. The organisations listed at the end of this post can negotiate directly with Dudley Council on your behalf.

The Recovery Timeline

When you miss a council tax payment in Dudley, the process follows a set sequence:

Reminder notice. Dudley Council sends a reminder giving you seven days to pay the missed instalment. If you pay within the seven days, your normal payment schedule continues.

Final notice. If you miss a second instalment after the reminder, the council issues a final notice. At this point, you lose the right to pay in monthly instalments — the entire remaining annual balance becomes due immediately.

Court summons. If the full balance is not paid, Dudley Council applies to the Magistrates' Court for a liability order. You will receive a court summons, and the council may add costs for correspondence and court expenses; check the summons for the amount.

Liability order. The court grants a liability order if the council can prove you owe the money. This gives the council additional enforcement powers. The hearing is administrative — the court checks the bill is valid and has not been paid. You can attend and explain your circumstances, but the liability order is granted unless the debt itself is in dispute.

Enforcement. With a liability order in hand, Dudley Council can take one or more of these steps:

  • Request your employer deducts payments from your wages (attachment of earnings)
  • Instruct the DWP to deduct from your benefits
  • Instruct enforcement agents (bailiffs) to collect the debt
  • Apply for a charging order against your property
  • In extreme cases, apply for committal to prison (very rare, and only where wilful refusal or culpable neglect is proved)

Your Rights at Each Stage

You have the right to contact Dudley Council at any point to discuss payment arrangements. In practice, the earlier you make contact, the more flexible the options:

  • Before a summons: the council can often set up a payment plan for the arrears alongside your current year's instalments
  • After a liability order but before bailiffs: the council may still agree to a direct payment plan, particularly if you can show income and expenditure
  • After bailiff instruction: the enforcement agent has their own fees schedule (set by law), and negotiation becomes harder

If a liability order has been granted and you believe it was wrong — for example, you had already paid, or you were not liable for the property — you can apply to the court to have the order set aside.

Payment Plans and Breathing Space

Dudley Council says it may be possible to agree an alternative payment arrangement. Contact Dudley Council Plus on 0300 555 2345 as soon as possible to discuss your circumstances.

If your debt situation is wider than just council tax, a registered debt adviser can apply for a Breathing Space order on your behalf. Breathing Space gives you 60 days of legal protection during which creditors — including Dudley Council — cannot pursue enforcement action, charge interest, or add fees. Mental Health Crisis Breathing Space lasts longer and has additional protections.

Breathing Space can only be set up through a registered debt adviser, not by you directly. StepChange and National Debtline (see below) can do this.

Check Whether You Are Entitled to Council Tax Reduction

Arrears sometimes build up because people do not realise they qualify for help. If you are on a low income or receiving Universal Credit, you may be entitled to Council Tax Reduction in Dudley, which covers up to 40% of your bill.

Claiming CTR will not wipe out existing arrears, but it reduces your ongoing liability — which makes any payment plan for the arrears more manageable. If you should have been receiving CTR earlier, you can apply to backdate the claim (though working-age backdating requires showing continuous "good cause" for the period you missed).

The Dudley Council Tax Reduction guide covers the claim process, income limits, and backdating rules.
