Cornwall Council Tax Reduction Cannot Be Backdated

Zero Backdating for Working-Age Claims

Cornwall Council's working-age Council Tax Support scheme has no discretionary backdating: a late claim cannot be moved back to cover an earlier period because of hardship or another reason. As a general rule, your award starts from the Monday after the council receives your claim or intention to claim. If Council Tax liability first arises within that same benefit week, the award starts on the date the liability began.

This catches people off guard because other benefits work differently. Housing Benefit can be backdated if you show "good cause." Pension-age Council Tax Reduction allows up to three months of automatic backdating. But Cornwall's local working-age scheme — the one that applies if you're below State Pension age — has no general discretionary backdating mechanism.

Why This Matters

If your income dropped in April but you didn't apply until July, you've lost three months of support permanently. There is no appeal, no discretionary exception, and no way to recover those months through the standard scheme.

To protect your start date, make sure your claim or intention to claim is received by Cornwall Council. Its online portal and Benefits Advice Line (0300 1234 121) are direct contact routes. Citizens Advice Cornwall can help you with the process, but contacting an advice service by itself is not a claim received by the Council. Even phoning the Council to say "I want to claim" establishes the date if the Council records that intention; follow up with the full application promptly.

The Practical Rule

If you need a new claim because your income drops or Universal Credit starts, apply promptly; if you already receive Council Tax Support, report a relevant change within 21 days. Don't wait until you have every document assembled — the council records the date it receives your claim or intention to claim, then gives you one month to provide outstanding evidence.

What If You Missed the Window

If you've already lost weeks or months of support because you didn't know about the zero-backdating rule, the standard scheme can't help. But Cornwall does run an Exceptional Relief scheme under Section 13A(1)(c). This is a discretionary fund for severe hardship. It won't literally "backdate" your award, but it can reduce or wipe out council tax arrears that built up during the gap.

Applying for Exceptional Relief involves a separate form plus the Policy in Practice Better Off Calculator (shared with the "Crisis and Resilience Team") and two months of bank statements. It's discretionary — not guaranteed — but it exists specifically for situations where the scheme's own rules create genuine hardship.

The Cornwall Council Tax Reduction guide explains both the zero-backdating rule and the Exceptional Relief application process step by step.
