BCP Council Tax Reduction for Disabled Residents and Carers

What Protected Group Status Means

BCP Council's working-age Council Tax Reduction scheme treats most claimants as "standard" — subject to the 20% minimum contribution and the Band C property cap. Protected groups are the exception. If your household qualifies, those two restrictions are removed entirely:

  • No 20% floor — your support can cover up to 100% of your eligible council tax
  • No Band C cap — support is calculated against your actual property band, not restricted to Band C
  • The £0.50 minimum-award cutoff still applies if your final calculated award is below 50p per week

The difference is substantial. A standard working-age claimant in a Band D property (£2,435.58 for 2026/27) pays a minimum of about £704 per year even on zero income. A protected group claimant in the same property with income below the applicable amount pays £0.

Who Qualifies as Protected

You or your partner must be receiving at least one of these:

  • Disability Premium, Enhanced Disability Premium, or Severe Disability Premium (within your legacy benefit or pension calculation)
  • Disabled Child Premium (if you have a disabled child in the household)
  • Carer Premium or Carer's Allowance
  • ESA Support Component (Employment and Support Allowance)
  • War Disablement Pension, War Widow's Pension, or War Widows Disablement Pension
  • Universal Credit with the LCWRA element (Limited Capability for Work and Work-Related Activity), Carer element, or Disabled Child element

The key is the specific benefit or element — receiving PIP or DLA alone does not automatically trigger protected status. What matters is whether the disability benefit generates a premium in your applicable amount calculation, or whether your UC includes the LCWRA or Carer element.

PIP and DLA Are Not Counted as Income

Regardless of protected group status, Personal Independence Payment and Disability Living Allowance are fully disregarded from the income assessment. They do not reduce your Council Tax Reduction award. The same applies to Attendance Allowance.

PIP and DLA also trigger another important exemption: if you receive the PIP daily living component, DLA care at the middle or highest rate, or Attendance Allowance, any non-dependant deductions for other adults living in your household are completely waived.

Carers Get Protected Status Too

If you or your partner receives Carer's Allowance or the Carer element within Universal Credit, you qualify as a protected group. This matters because many carers are on very low incomes — they cannot work full-time while providing care, and Carer's Allowance is £86.45 per week for 2026/27.

Note that Carer's Allowance is counted as income for the means test, while a qualifying Carer Premium is added to your applicable amount. BCP assesses the two figures separately. Protected group status then removes the 20% minimum and band cap.

The Common Misclassification Problem

BCP Council's online application form collects your benefit details, but it is possible for the system to miss a qualifying benefit — especially when claims are based on UC elements rather than legacy benefits. If you receive the LCWRA element in UC but the council's automated assessment does not flag it, you can end up classified as standard working-age and lose hundreds of pounds per year in support.

Check your Council Tax Reduction decision notice. If it shows an 80% maximum or references a Band C cap, and you believe you qualify as protected, request a reconsideration within one month of the decision date. Provide a copy of your benefit award letter or UC assessment breakdown showing the qualifying element.

Other Disability-Related Discounts

Protected group status within the Council Tax Reduction scheme is separate from other disability discounts:

  • Disabled Band Reduction — if your home has qualifying adaptations for a disabled resident (such as an additional bathroom or kitchen, a room needed for the disabled person, or wheelchair space), you can apply to BCP Council for the council tax charge to be reduced by one band
  • Severe Mental Impairment exemption — if you are certified as severely mentally impaired, you may be disregarded for council tax purposes (if you are the sole liable person, the property may be fully exempt)

These stack with Council Tax Reduction. Apply for all that apply to your situation.
