How to Backdate Council Tax Reduction in Cheshire East
Up to One Year — But You Have to Prove It
Cheshire East allows working-age claimants to backdate their Council Tax Support by up to one year from the date the council receives your written backdating request. That's significantly more generous than many English councils, which cap backdating at three months.
But there's a catch: you must demonstrate continuous "good cause" for the entire backdating period. The council won't simply award you retrospective support because you didn't know the scheme existed. You need to explain — and evidence — why you couldn't apply sooner.
What Counts as Good Cause
The council evaluates good cause on a case-by-case basis, but the legal framework (drawn from welfare case law and Citizens Advice guidance) recognises several categories:
- Serious illness or hospitalisation — physical or mental health conditions that prevented you from managing your affairs
- Bereavement — the death of a close family member that disrupted your ability to handle administrative tasks
- Misleading official advice — being told by DWP, a council officer, or another agency that you didn't need to apply separately, or that UC covered your council tax automatically
- Domestic crisis — fleeing domestic abuse, sudden homelessness, or a severe family breakdown
- Mental health conditions — depression, anxiety, or other conditions that made it impossible to engage with paperwork and online forms
"I didn't know about the scheme" or "I forgot to apply" does not constitute good cause on its own. But if the reason you didn't know was that DWP told you everything was handled, that's misleading advice — and that does qualify.
The "Continuous" Requirement
Good cause must cover the full backdating period without gaps. If you're requesting six months of backdating, you need to show that the reason you couldn't apply persisted for all six months.
If your circumstances changed midway — say you were hospitalised for three months and then recovered but still didn't apply for another three — the council may only backdate to the point where good cause ends. The strongest requests involve a single, documented reason that spans the entire period.

How to Make the Request
You can indicate that you want backdating on your main online Council Tax Support application form. Alternatively, submit a separate written request to the Benefits Team. Either route works, but the clock starts when they receive your request — not when you first thought about applying.
Include with your request:
- A clear statement of the period you're asking to be backdated
- The specific reason you couldn't apply sooner
- Supporting evidence — hospital discharge letters, GP letters, a timeline of events, copies of misleading correspondence from DWP or other agencies
- Confirmation that you would have been eligible throughout the backdated period (income and savings within limits)
Pension-Age Claimants Get Automatic Backdating
If you've reached State Pension Credit qualifying age, the rules are different. Pension-age claimants receive up to three months of automatic backdating with no need to prove good cause. This is governed by national regulations, not the local scheme.
What Happens If Your Request Is Refused
If the council refuses your backdating request, you have the right to challenge the decision. Submit a written reconsideration within one calendar month of the decision notice. If the council upholds its refusal, you can appeal to the Valuation Tribunal for England.
Don't let a refusal go unchallenged if you have genuine evidence of good cause. The council's initial decision is made by a caseworker — a reconsideration may be reviewed by a more senior officer who reaches a different conclusion.
The Cheshire East Council Tax Reduction Guide includes a backdating letter template with four sample good-cause narratives covering the most common scenarios, plus a checklist of evidence to attach.
