How to Appeal a Council Tax Support Decision in Wakefield
The Three-Stage Appeal Process
If you disagree with a Council Tax Support decision in Wakefield — whether it's a lower award than expected, a rejection, or a refused backdating request — you have three escalation stages. Each must be completed in order.
Stage 1: Informal internal review. Write to Wakefield Council's Revenues and Benefits team asking them to re-examine the decision. Explain specifically what you believe is wrong — an incorrect income calculation, a misapplied non-dependant deduction, a wrong effective date. Ask promptly, and keep the statutory appeal deadlines in mind.
Stage 2: Formal Section 16 grievance. Under Section 16 of the Local Government Finance Act 1992, you submit a formal written grievance to the billing authority. This is legally distinct from the informal review — it triggers a statutory obligation for the council to respond. State the specific grounds: incorrect calculation of non-DWP income, improper application of the £7.50 deduction, wrong income band, or any other error.
Stage 3: Valuation Tribunal for England (VTE). If the council rejects your grievance or fails to respond within two months, you can appeal to the VTE. The deadline is two months from the council's written decision — or four months from your original Section 16 submission if the council never responded at all.
Critical Deadlines
These are statutory deadlines. Use the dates below to preserve your right to appeal:
- Section 16 grievance: Submit in writing and keep proof of the date it reaches the council
- Council response to grievance: The council has 2 months to issue a written decision
- VTE appeal: 2 months from the council's decision letter, or 4 months from your original grievance if the council didn't respond
- VTE hearing: The tribunal schedules this
You Must Keep Paying While You Appeal
This is non-negotiable. Submitting an appeal or grievance does not suspend your Council Tax liability. You must continue paying according to your bill's instalment schedule throughout the entire process. If you stop paying because you're disputing the amount, you'll accumulate arrears and potentially face enforcement — regardless of whether your appeal ultimately succeeds.
If the appeal succeeds and you've been overpaying, the council will recalculate and credit the difference to your account.

What to Include in Your Appeal
Whether you're writing a Stage 1 review request or a Stage 2 formal grievance, include:
- Your Council Tax reference number
- The date of the decision you're challenging
- The specific element you dispute (the income band applied, the deduction amount, the effective date, the backdating refusal)
- Why you believe the decision is wrong, with reference to the scheme rules
- Any supporting evidence (payslips, bank statements, benefit award letters, correspondence showing misdirection)
Keep copies of everything you send. Note every date you post or email a document. The timeline tracking matters because the VTE deadline runs from specific correspondence dates.
The VTE Process
The Valuation Tribunal for England handles CTS appeals at no cost to you. Appeals are submitted online at valuationtribunal.gov.uk or by phone on 0303 445 8100. You can present your case yourself — no legal representation required.
The tribunal can uphold, vary, or overturn the council's decision. Its ruling is binding on both parties.
Note that the VTE handles Council Tax Support disputes. Property band challenges go to the Valuation Office Agency (VOA), and complaints about maladministration in the process go to the Local Government and Social Care Ombudsman.
The Wakefield Council Tax Reduction guide includes an appeal timeline tracker and a decision notice worksheet for recording every stage of the dispute process with the right deadlines calculated.
